A RESOLUTION AUTHORIZING EXECUTION OF
AN AGREEMENT FOR A TRAFFIC CIRCULATION
ELEMENT WITH MID -SOUTH ENGINEERING.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the appropriate City Councils are hereby
authorized to execute a Consultant Agreement for a Traffic Circulation
Element in compliance with the Local Government Comprehensive Planning
Act with Mid -South Engineering for a sum not to exceed $4,500.00.

RECORD OF COUNCIL VOTE
CONSULTANT AGREEMENT
THIS AGREEMENT, made and entered into this /-,/ day of
, 1979 by and between the CITY OF TAMARAC, FLORIDA, a municipal
corporation created and existing under the laws of the State of Florida
(hereinafter referred to as "CITY") and MID SOUTH ENGINEERING COMPANY,
233 Commercial Boulevard, Lauderdale -by -the -Sea, Florida, in the capacity of
Traffic Circulation and Transportation Planning Consultant (hereinafter referred
to as "CONSULTANT").
W I T N E S S E T H:
WHEREAS, the City approves Consultant as a Traffic Circulation and
Planning Consultant,to prepare the Traffic Circulation portion of its Compre-
hensive Plan and other related services, and,
WHEREAS, the City and Consultant desire to reduce to writing their
Agreement setting forth the services to be rendered by the Consultant to the
City and the consideration to be paid to Consultant for said services, and
WHEREAS, services which cost less than $5,000 are exempt from the
Consultant Competitive Negotiations Act,
NOW, THEREFORE, in consideration in the mutual covenants herein
expressed, it is agreed between the parties as follows:
SECTION 1: SCOPE OF SERVICES
The Consultant will perform in a professional and proper manner
the necessary activities required to develop a Traffic Circulation Element in
compliance with the requirements with the Local Government Comprehensive
Planning Act. The Scope of Services for performing a Traffic Circulation study
for the City is defined in Exhibit "A" attached hereto and made a part hereof.

SECTION 2: GENERAL CONSIDERATIONS
A. Compensation
As compensation for the services rendered by the Consultant hereunder, the
City agrees to pay a lump sum fee of Four Thousand Five Hundred ($4,500.00)
Dollars to the Consultant..
Invoices will be rendered monthly for services performed for the period.
Invoices will reflect progress on the Traffic Circulation Element and shall set
forth a percentage of the work performed on the project.
A final invoice will be rendered for the last 10% of fee ($450.00) after sub-
mission of the printed final report. This is expected to occur in either April
or May, 1980. Said fee shall be paid monthly upon receipt of invoice from
Consultant.
B. Termination
The City reserves the right to terminate this Agreement at any time upon a
thirty (30) days written notice to the Consultant. At such time that the
Consultant receives notification of the intent of the City to terminate the
contract, the Consultant shall not perform any further services. In the event
of any termination, the Consultant will be paid for all services rendered as
of the date of receipt of said notice, but in no event shall it be paid more
than $4,500.00. In the event the City terminates the Contract, Consultant will
deliver all documents, maps, drawings, data and worksheets prepared to date of
termination to the City.
C. Documents
All documents, maps, drawings, data and worksheets prepared by the
Consultant under this Agreement shall become and remain the property of the City.
D. Limitation of Authority
Except upon express permission of the City Council, Consultant may not
incur any obligations on behalf of, or in the name of the City.

E. Work Initiation and Completion of Services
The Consultant shall commence work upon execution of this Agreement and
shall submit its report prior to January 1, 1980.
E. -Services to be Provided by City
The City shall make available to the Consultant all existing information
available at the City which are necessary for the Consultant to complete the
Traffic Circulation Element.

EXHIBIT "A"
SCOPE OF SERVICES
TASK 1 - TRAFFIC CIRCULATION DATA COLLECTION
The Consultant will collect existing quarterly traffic counts taken
by the Florida Department of Transportation and the Broward County Traffic
Engineering Department. Quarterly count stations within and adjacent to the
City limits will be identified and inventoried for 1978 and 1979 conditions.
The Consultant will inventory the existing arterial highway system in the
City and attain existing plans and programs such as the Broward Area
Transportation Study (BATS) Year 2000 Plan, the County Trafficways Plan, the
Broward County MPO Short -Range Improvement Program, and other relevant reports
and studies. The purpose of the data collection effort is to obtain all
existing information relevant to the City's Traffic Circulation Element,
such that an analysis can be made of existing traffic and transportation
characteristics.
TASK 2 - GOALS & OBJECTIVES
The Consultant will prepare preliminary Goals & Objectives for the
Traffic Circulation Element considering the City's Future Land Use Element.
The preliminary Goals & Objectives will be presented to City staff for
review prior to presentation to the Local Planning Agency (LPA).
TASK 3 - ANALYSIS OF TRAFFIC DATA
The Consultant will analyze the data and future highway plans from
Task 1 relative to the City's Goals & Objectives in Task 2. Traffic volumes
and generalized volume to capacity ratios will be developed for the arterial
system. Capacity deficiencies and traffic circulation problems will be
identified.

TASK 4 - FORMULATE TRAFFIC CIRCULATION ELEMENT
The Consultant will prepare a Traffic Circulation Plan for the
existing and future traffic needs of the City and surrounding areas.
Future traffic volumes will be obtained from the BATS Year 2000 Trans-
portation Plan. Highway system right-of-way and design requirements will
be identified for trafficways on the Broward County trafficways plan and.
local City collectors as specified by the City staff. Locations where
expansion of the highway system will create impact on surrounding areas
will be identified. A bikeway plan will also be prepared. The consistency
of the City's Traffic Circulation Element with the City's Future Land Use
Element and the plans of the adjacent local municipalities, county and
state agencies will be assessed. A short-range improvement program will
be prepared.
TASK 5 - FINAL REPORT AND PUBLIC HEARINGS
The Consultant will prepare maps and graphics at a scale to be
determined by the City for various items such as existing highway system,
existing traffic flow, existing volume to capacity ratios, existing
public transit routes, bikeway plan, short-range transportation improve-
ments, future highway system, including right-of-way design and projected
traffic volumes.
A report will be prepared to document the findings and
recommendations of the Traffic Circulation Element. The Element will
satisfy, as a minimum, all requirements of the State of Florida Local
Government Comprehensive Planning Act (LGCPA) and all other applicable
laws and regulations.

The Consultant will prepare the report for review and revision
by LPA and City. After formal review in accordance with the LGCPA by
appropriate State, Regional and County Agencies and final revisions and
approval by City, the Consultant will print twenty-five (25) copies of
the final report for distribution by the City. Consultant will also
be available to meet with the City's Local Planning Agency and Council
during public hearings and discussions on the Traffic Circulation Element.
