CITY OF TAMARAC, FLORIDA
RESOLUTION NO.
A RESOLUTION GRANTING AN EXCEPTION PERMIT FROM
PLATTING REQUIREMENTS FOR CERTAIN PROPERTY OWNED
BY TAMARAC UTILITIES, INC.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: Findings of Fact
1. The property described on Exhibit A attached
hereto is owned by Tamarac Utilities, Inc.
2. As part of the Countywide 201 Wastewater program,
Broward County wishes to construct a pump station on that property.
3. When completed the pump station could be used by
Tamarac Utilities to pump some of its effluent into the Broward
County wastewater system which would eliminate a building
moratorium caused by alleged inadequate wastewater treatment
facilities on the part of Tamarac Utilities, Inc.
4. The pump station will not be permanently manned.
5. The pump station is financed by a federal grant
which might be lost if the project is held up.
6. If the grant was lost the cost of construction
might be passed on to the citizens of Tamarac in higher rates.
7. Tamarac Utilities, Inc. has submitted a Plat for
this property for consideration by the appropriate officials in
Tamarac.
8. Contrary to City ordinances the Plat is
not adjacent to dedicated right-of-way and such access apparently
cannot be obtained.
9. The Contractor has applied for permits to construct
the pump station and other work related thereto.
10. The Tamarac City Council does not wish to delay
this project.
11. Section 20-4 of the Tamarac City Code authorizes
the grant of an Exception Permit for land of such size and shape
that strict conformity with the platting requirements would constitute

a hardship.

12. The City Council finds that an undue hardship

would exist because of the possible loss of the federal grant and
4
because the station would not be regularly manned, if all of the
5
platting standards set forth in Chapter 20 of the City Code were
6
complied with.

13. The City Council finds that the granting of the
8
exception would not set a precedent in any way for other and unlike
9
conditions.

14. The City Council finds that such permit for
11
exception would not be detrimental to the interests of the
12
community.

15. The City Council finds that the property is
14
adequately served with water and sewer facilities and no further
15
construction is contemplated.

16. The City Council finds that no additional road
17
right-of-way dedications are required for the pump station itself,
18
but the Council further finds that road dedications between
19
Commercial Blvd. and State Road 7 will be necessary and required
20
in the future.

17. The City Council finds that no additional easements
22
are required in the property described in Exhibit A and that no
23
dedication or recreational land is required for the proposed use of
24
the property.

SECTION 2: An Exception Permit from the platting
26
requirements of Section 20 of the Tamarac City Code is hereby granted
27
subject to the following conditions: No final inspection is to be
28
made by either the Building or Engineering Department without further
29
approval of the City Council or the approval of the Plat having been
30
obtained.
