A RESOLUTION APPROVING AND AUTHORIZING
THE EXECUTION OF A DEVELOPER'S AGREEMENT

FROM HOMELAND N.V. FOR THE WATERSIDE

PROJECT.

WHEREAS, the City Council has received and reviewed a
7
developer's agreement submitted by Homeland N.V. for the project
8
known as Waterside; and
9
WHEREAS, it appears that the development review requirements
10
of the Broward County Land Use Plan have been fulfilled; and
11
WHEREAS, the City Council desires to approve the developer's
12
agreement.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC:

SECTION 1: That since it appears the development review
15
requirement under the Broward County Land Use Plan have been ful-
16
filled, the City Council does hereby approve entry into a developer's
17
agreement with Homeland N.V. for its Waterside Project, the basic
18
terms of which would provide; 1) That Homeland N.V. would cause to be
19
constructed all public off -site waste water paving and drainage
20
facilities on the property, 2) that Homeland N.V. would construct
21
N.W. 79th Avenue, and the culvert crossing south of the Waterside
22
plat, in exchange for the City's waiving of the bulkhead around the
23
perimeter of the property, subject to posting of proper improvement
24
fees, bond or letter of credit, 3) that the road work be completed
25
prior to any final inspection for any homes built on lots shown on
26
the latest approved site plan, except for three(3)buildings to be
27
used for models, 5) that the owner donate to the City, at no cost to
28
the City, two (2) ERC's, for use by the City, for water and sewer
29
purposes, 6) the owner submit to the City beautification plans for
30
N.W. 79th Avenue, and other work to be performed, which will be
31
approved by the City Council.

SECTION 2: That the Mayor and City Manager are hereby autho-
rized to execute said agreement on behalf of the City of Tamarac.
SECTION 3: This Resolution shall become effective immediately
upon its adoption.
