Ord. # 2405 May 29, 2019 Page 1 of 5 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2019- / % AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 10, ARTICLE 4 OF THE CITY OF TAMARAC CODE OF ORDINANCES LAND DEVELOPMENT CODE, ENTITLED "DEVELOPMENT AND DESIGN STANDARDS"; SPECIFICALLY, AMENDING SECTION 10-4.10 ENTITLED "SIGNS" BY CREATING A NEW SECTION 10- 4.10(D)(3)(m) TO BE ENTITLED "HUMAN TRAFFICKING PUBLIC AWARENESS SIGNS"; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Human Trafficking is an International crisis that affects children and adults around the world with people being used for sex trafficking, labor trafficking and organ trafficking with a life expectancy once they become a trafficking victim of only seven years; and WHEREAS, sexually oriented businesses such as massage parlors, strip clubs, adult book stores and escort services have a marked propensity to be involved in human trafficking; and WHEREAS, some of the abuses victims of human trafficking are perpetrated in hotels, motels and extended stay establishments, and {00302678.2 2704-0501640) law; CODING: Words in stFike thr,,,,,,ti type are deletions from the existing Words in underscore type are additions. Ord. # 2405 May 29, 2019 Page 2 of 5 WHEREAS, it is vital to the health, safety and welfare of every person for all governmental subdivisions to be involved at the local, state, federal and international levels to do what can legally be done to protect residents and visitors; and WHEREAS, the City of Tamarac prides itself in being a safe place to live, work and play, and WHEREAS, the City Commission of the City of Tamarac has determined that amending the Tamarac Land Development Code to include a requirement of posting human trafficking awareness signage is in the best interests of the health, safety, and general welfare of the citizens and residents of the City of Tamarac. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: Section 1: The foregoing WHEREAS clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. Ord. # 2405 May 29, 2019 Page 3 of 5 Section 2: The City Commission of the City of Tamarac hereby amends Chapter 10, Section 10-4.10 of the City's Code of Ordinances, Land Development Code, entitled "Signs", specifically amending Article 4, entitled "Development and Design Standards", by creating section 10-4.10(D)(3)(m), to be entitled "Human Trafficking Public Awareness Signs", as follows: 10-4.10(D)(3)(m), Human Trafficking Public Awareness Signs. (m) Postinq of Human Trafficking Public Awareness Signs Human trafficking means transporting, soliciting, recruiting, harborinq, providing, enticing, maintaining, or obtaining another person for the purpose of exploitation of that person regulated pursuant to F.S. Ch. 787, and defined in F.S. § 787.06, as may be amended. (i) The employer at each of the following establishments shall display public awareness signs in a conspicuous location that is clearly visible to the public and employees of the establishment: A) A stdD club or other adult entertainment business. (B) A massage establishment. (C) A business or establishment that offers massage services for compensation that is not owned by a health care professional reaulated pursuant to F.S. Ch. 456. and defined in F.S. 456.001. (D) A hotel. (ii) The required public awareness sign must be at least eiqht and one-half inches by 11 inches in size, must be printed at least in at least 16 point type, and must state substantially the following in English, Mandarin and Spanish: "If you or someone you know is being forced to engage in an activity and cannot leave — whether it is prostitution, housework, farm work, factory work, retail work, restaurant work, or any other activity — call the National Human Trafficking Resource Center at 1-888-3737-888 or text INFO or HELP to 233-733 to access help and services. {00302678.2 2704-0501640) CODING: Words in strike thFough type are deletions from the existing law; Words in underscore type are additions. Posted pursuant to Section 787.29, Florida Statute and Tamarac Land Development Code Section 10- awe UTK)TO] SECTION 3: It is the intention of the City Commission of the City of Tamarac, Florida that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered, re -lettered and the word "Ordinance" may be changed to Section," "Article" or such other word or phrase in order to accomplish such intention. SECTION 4: If any clause, section, or other part or application of this Ordinance shall be held by any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part or application shall be considered as eliminated and so not affecting the remaining portions or applications remaining in full force and effect.
