R-2000 - /3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE TRANSFER OF RIGHTS AND RESPONSIBILITIES FOR TWENTY SEVEN (27) STREETLIGHTS LOCATED WITHIN THE WOODLANDS ESTATES AND WOODLAND GREENS SUBDIVISIONS FROM BROWARD COUNTY TO THE CITY OF TAMARAC; AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE THE TRANSFER OF SAID STREETLIGHTS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Public Works Department maintains streetlights within the City of Tamarac; and WHEREAS, the Woodlands Estates Homeowners' Association has requested that the City upgrade the streetlights within the Woodlands Estates subdivision; and WHEREAS, the Public Works Department has determined that such upgrade would be appropriate; and WHEREAS, Florida Power and Light, upon contact by the City, indicated that the aforementioned streetlights where under Broward County jurisdiction; and WHEREAS, upon contacting Broward County, the City was informed they would not be willing to upgrade the aforementioned streetlights as they are no longer within Broward County's Unincorporated Streetlight District; and WHEREAS, the Woodlands Estates and Woodland Greens subdivisions are part of Tamarac and deserve the same level of service as other City subdivisions; and Temp Reso. #8874 December 17, 1999 Page 2 WHEREAS, Broward County, through a letter of authorization, has agreed to relinquish all rights and responsibilities for said streetlights, a copy of said letter is attached hereto as Exhibit "A"; and WHEREAS, annual funding in the amount of $3,390 exists in the general fund account entitled "Electricity -Streets" for said purpose; and WHEREAS, The Director of Public Works recommends accepting the transfer of the aforementioned streetlights from Broward County to the City of Tamarac; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the Citizens and residents of the City of Tamarac to have the aforementioned streetlights transferred from Broward County to the City of Tamarac. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The transfer of twenty seven (27) streetlights within the Woodlands Estates and Woodland Greens subdivisions from Broward County to the City of Tamarac is HEREBY approved. SECTION 3: The appropriate City officials are HEREBY authorized to execute said transfer. SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. 1 Temp Reso. #8874 December 17, 1999 Page 3 SECTION 5: If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not effect other provisions or application, and to this end the provisions of this resolution are declared to be severable.
