A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, GRANTING
THE VACATION OF EASEMENTS OF THE
LAKE/DRAINAGE EASEMENTS, LAKE
MAINTENANCE EASEMENTS AND PORTIONS
OF DRAINAGE EASEMENTS WITHIN THE
WESTPOINT 7 PLAT LOCATED AT HIATUS
ROAD, NORTH OF COMMERCIAL BOULEVARD,
SPECIFICALLY A PORTION OF TRACT "B" AND
"C" AND ALL OF TRACT "D" OF THE
"WESTPOINT SECTION 7" PLAT, ACCORDING
TO THE PLAT THEREOF AS RECORDED IN
PLAT BOOK 162, PAGE 23 OF THE PUBLIC
RECORDS OF BROWARD COUNTY FLORIDA;
CASE NO. 3-P-00; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Easements described in Exhibit "'I" were dedicated to the public on
January 15, 1997 at the time of the initial recordation of the Plat; and
WHEREAS, the property owner, Pritzker Realty Group, has determined that these
easements are no longer needed and that new easements shall be dedicated upon the
filing of the site plan; and
WHEREAS, the City Engineer and franchised Utility Companies have been
contacted and all have stated no objection to the vacation of easements of the
lake/drainage easements, lake maintenance easements and portions of drainage
easements within the Westpoint 7 Plat to facilitate any future improvements; and

WHEREAS, the Director of Community Development recommends approval of these
vacation of easements; and
WHEREAS, the Planning Board recommended approval on May 17, 2000; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to grant the vacation
of easements of the lake/drainage easements, lake maintenance easements and portions
of drainage easements within the Westpoint 7 Plat located at Hiatus Road, north of
Commercial Boulevard.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the vacation of easements of the lake/drainage
easements, lake maintenance easements and portions of drainage easements within the
Westpoint 7 Plat (attached hereto as Exhibit 1") located at Hiatus Road, north of
Commercial Boulevard; specifically a portion of Tract "B" and Tract °C" and all of Tract "D"
of the "Westpoint Section 7" Plat, according to the Plat thereof as recorded in Plat Book
162, Page 23 of the Public Records of Broward County, Florida; Case No. 3-P-00; is
hereby granted.

SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.

the County Commission Meeting Room (Room 422), 115 South Andrews Avenue,
Governmental Center, to consider the vacation and abandonment of drainage, lake and
lake maintenance easements, the substance of which is as follows: Drainage, lake and
lake maintenance easements, lying in Tracts B, C and D of "Westpointe Section 7 Plat,"
according to the plat thereof, recorded in Plat Book 162, Page 23 of the public records of
