A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, FOR THE
VACATION OF THE FOLLOWING SECTIONS OF
RIGHT-OF-WAY (R.O.W.); DESCRIBED AS A
PORTION OF THE RIGHTS OF WAY FOR NW
106 AVENUE (HIATUS ROAD) AS SHOWN ON
"FLORIDA FRUIT LANDS COMPANY'S
SUBDIVISION NO. 2" AS RECORDED IN PLAT

FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the sections of Right -of -Way (R.O.W.) described in Exhibits "A", "B" and
"C" (attached hereto) were dedicated to the public at the time of the initial recordation of
the Plats referenced within Exhibits "A", °B" and "C"; and
WHEREAS, the property owner, City Furniture, has requested the vacation of Right -
of -Way (R.O.W.) of the sections of R.O.W. described in Exhibits "A", °B" and "C" in orderto
be consistent with the proposed site plan and wetland mitigation plan for the property; and
WHEREAS, the City Engineer has been contacted and has stated no objection to
the vacation of the Right -of -Way (R.O.W.);and
WHEREAS, the City of Tamarac in coordination with the Westpointe Land, L.L.C.
has constructed Hiatus Road in an alternate location rendering the R.D.W. for NW 106
Street (Hiatus Road) described in Exhibit "A" unnecessary; and
WHEREAS, the City Engineer has indicated that the roadway reservations
described in Exhibits "A", "B" and °C" are no longer envisioned to be utilized in the City's
future roadway plans; and
WHEREAS, the Director of Community Development recommends approval of this
request; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to vacate the

following sections of Right -of -Way (R.O.W.); described as a portion of the Rights of Way
for NW 106 Avenue (Hiatus Road) as shown on "Florida Fruit Lands Company's
Subdivision No. 2", "Gould South" and "S&N Plat" being more particularly described in
Exhibit "A"; as well as a portion of the thirty (30) foot road reservation in the northwest'/4 of
Section 7, Township 49 South, Range 41 East as shown on "Florida Fruit Lands
Company's Subdivision No. 2" and "Gould South" being more particularly described in
Exhibit "B"; as well as a portion of the thirty (30) foot road reservation in the northeast % of
Section 7, Township 49 South, Range 41 East as shown on "Florida Fruit Lands
Company's Subdivision No. 2" being more particularly described in Exhibit "C"; in order to
be consistent with the proposed site plan and wetland mitigation area for City Furniture.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: The following sections of Right -of -Way (R.O.W.); described as a
portion of the Rights -of -Way for NW 106 Avenue (Hiatus Road) as shown on "Florida Fruit
Lands Company's Subdivision No. 2", "Gould South" and "S&N Plat" being more

particularly described in Exhibit "A"; as well as a portion of the thirty (30) foot road
reservation in the northwest '/4 of Section 7, Township 49 South, Range 41 East as shown
on "Florida Fruit Lands Company's Subdivision No. 2" and "Gould South" being more
particularly described in Exhibit "B"; as well as a portion of the thirty (30) foot road
reservation in the northeast % of Section 7, Township 49 South, Range 41 East as shown
on "Florida Fruit Lands Company's Subdivision No. 2" being more particularly described in
Exhibit "C"; in order to be consistent with the proposed site plan and wetland mitigation
area for City Furniture; are hereby vacated.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

EFFECTIVE DATE.
WHEREAS, the sections of Right -of -Way (R.O.W.) described in Exhibits "A", "B" and
"C" (attached hereto) were dedicated to the public at the time of the initial recordation of
the Plats referenced within Exhibits "A", "B" and "C"; and
WHEREAS, the property owner, City Furniture, has requested the vacation of Right -
of -Way (R.O.W.) of the sections of R.O.W. described in Exhibits "A", "B" and "C" in orderto
be consistent with the proposed site plan and wetland mitigation plan for the property; and
WHEREAS, the City Engineer has been contacted and has stated no objection to
the vacation of the Right -of -Way (R.O.W.);and
WHEREAS, the City of Tamarac in coordination with the Westpointe land, L.L.C.
has constructed Hiatus Road in an alternate location rendering the R.O.W. for NW 106
Street (Hiatus Road) described in Exhibit "A" unnecessary; and
WHEREAS, the City Engineer has indicated that the roadway reservations
described in Exhibits "A", "B" and "C" are no longer envisioned to be utilized in the City's
future roadway plans; and
WHEREAS, the Director of Community Development recommends approval of this
request; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to vacate the

following sections of Right -of -Way (R.O_W.); described as a portion of the Rights of Way
for NW 106 Avenue (Hiatus Road) as shown on "Florida Fruit Lands Company's

Exhibit "A"; as well as a portion of the thirty (30) foot road reservation in the northwest Y4 of
Section 7, Township 49 South, Range 41 East as shown on "Florida Fruit Lands
Company's Subdivision No. 2" and "Gould South" being more particularly described in
Exhibit "B"; as well as a portion of the thirty (30) foot road reservation in the northeast % of
Section 7, Township 49 South, Range 41 East as shown on "Florida Fruit Lands
Company's Subdivision No. 2" being more particularly described in Exhibit "C"; in order to
be consistent with the proposed site plan and wetland mitigation area for City Furniture.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: The following sections of Right -of -Way (R.O.W.); described as a
portion of the Rights -of -Way for NW 106 Avenue (Hiatus Road) as shown on "Florida Fruit
Lands Company's Subdivision No. 2", "Gould South" and "S&N Plat" being more

SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
