R-2000.E A RESOLUTION OF THE CITY OF TAMARAC, FLORIDA, SUPPORTING A LEGISLATIVE INITIATIVE TO REFORM THE MUNICIPAL REVENUE SHARING PROGRAM AND THE MUNICIPAL FINANCIAL ASSISTANCE TRUST FUND; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Municipal Assistance Trust Fund and the Municipal Revenue Sharing Program were created in 1971 and 1972, for the purpose of providing a minimum level of revenue parity, a reliable and bondable revenue source, and to reduce the need for increasing revenues at the local level; and WHEREAS, the aforementioned municipal revenue sharing programs have suffered from substantial decline in revenues; and WHEREAS, the aforementioned municipal revenue sharing programs rely heavily on net cigarette tax collections which account for approximately seventy percent (70%) or $157.4 million of municipal revenue sharing dollars; and WHEREAS, net cigarette tax collections have declined by 68 percent; and WHEREAS, the State of Florida Legislature and the United States federal government are implementing policies to reduce the use of tobacco related products; and WHEREAS, the decline in use of tobacco related products would improve the health of many Florida U.S. citizens; and WHEREAS, the decline in the sale of tobacco related products will result in the continuing decline in the revenues for Florida's 401 municipalities; and Temp. Reso. #8851 —December 2, 1999 Page 2 WHEREAS, the Florida League of Cities recommends supporting legislation that restructures the municipal revenue sharing program that includes a dedicated funding source to replace the cigarette tax revenues; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to support municipal revenue sharing reform legislation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and are HEREBY made a specific part of this Resolution. SECTION 2: That City Commission of the City of Tamarac, Florida, supports the Florida League of Cities legislative initiative to change the financial structure of the Municipal Financial Assistance Trust Fund and the Municipal Revenue Sharing Program. SECTION 3: The City Commission hereby petitions the Florida Legislature to replace the cigarette tax as a primary dedicated funding source with a reliable and stable revenue source providing adequate growth to enhance the City's ability to meet the needs of its community. SECTION 4: The City of Tamarac hereby encourages the Florida Legislature to provide a financial commitment to the Municipal Financial Assistance Trust Fund and the Municipal Revenue Sharing Program equivalent to the per capita funding level established in fiscal year 1989-90. 1 Temp. Reso. #8851 —December 2, 1999 Page 3 SECTION 5: That the City Clerk is hereby authorized and directed to transmit a copy of this resolution to the Broward County Legislative Delegation, the Broward County League of Cities and the Florida League of Cities. SECTION 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 7: This Resolution shall become effective immediately upon its passage and adoption.
