R-2000-182 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE AN AGREEMENT BETWEEN THE CITY OF TAMARAC AND DARANY AND ASSOCIATES FOR PROVIDING CONSULTING SERVICES RELATED TO THE FIRE RESCUE LIEUTENANT PROMOTIONAL EXAMINATION PROCESS FOR AN AMOUNT OF $11,500; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, there is a need for services and assistance with administering the fire rescue lieutenant promotional examination; and WHEREAS, Requests for Proposals (RFP) were solicited and four firms submitted proposals as follows: 1) Resource Management Associates, Inc.; 2) ATEC; 3) Fire Service Technology, Inc.; and 4) Darany and Associates; and WHEREAS, upon review and evaluation by staff, it was determined that Darany and Associates is the most responsible and responsive proposer meeting all requirements of the RFP; and WHEREAS, funds exist in the Fire Department budget under account number 120-4501-522-34-02 - Other Consulting Services. WHEREAS, it is the recommendation of the Fire Chief, Director of Personnel, and Purchasing/Contracts Manager that the proposal be awarded and an agreement be executed with Darany and Associates; and Temp. Reso. #9057 June 28, 2000 Page 2 WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to authorize the appropriate City Officials to execute an agreement in the amount of $11,500 with Darany and Associates for providing consulting services related to the Fire Rescue Lieutenant Promotional Examination for an amount of $11,500. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The appropriate City officials are hereby authorized to award and execute an Agreement between the City of Tamarac and Darany and Associates for providing consulting services related to the Fire Rescue Lieutenant Promotional Examination for amount of $11,500 (attached hereto as Exhibit 1 "). SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 11 1 Temp. The period of this agreement shall be from date of execution through September 1, 2000, or satisfactory completion and performance of services described in attached Exhibits as determined by City, whichever is later. 2. Consultant agrees to perform the services described In Exhibits A, B, C and ❑ attached hereto and incorporated herein as if•set forth in full. For satisfactory performance of said services described in Exhibit A, the City shall pay Consultant an amount not to exceed Eleven Thousand Five Hundred and no/100 Dollars ($11,600). Payment shall be made within thirty (30) days after the City's receipt and approval of Consultants statement of services and costs, prepared in such form and detail as the City may specify. Consultant shall not incur costs for performance of services under this Agreement in excess of these amounts without the prior written authorization of the City Manager or designee. 3. In performing services under this Agreement, Consultant shall be deemed an independent Contractor and shall not act as nor be an agent or employee of the City. As an independent contractor, Consultant will be solely responsible for determining the means and methods for performing the professional and/or technical services described in Exhibit A. This Agreement shall not be assigned by Consultant; any attempt to do so shall be void and have no effect- All of consultant's activities will be at its own risk and Consultant is hereby given notice of its responsibility for arrangements to guard against physical, financial, and other risks as appropriate. Consultant shall observe and abide by all applicable laws and regulations, including, but not limited to, those of the City of Tamarac relative to conduct on its premises. Except as specifcally authorized by the City in writing, information and other data developed or acquired by or furnished to Consultant in the performance of this Agreement shall be used only in connection with the services provided the City. All drawings and specifications developed as a result of this Agreement shall become the property of the City of Tamarac. 6. Either the City or Consultant may terminate performance under this Agreement at any time by notifying the other party in writing at least thirty (34) days in advance of the effective date of termination specified In such notice. 6. consultant shall notify the City promptly of any expected delay in performance of services. However. Consultant shall not be liable for delays in performance beyond Its reasonable control. 7. The City may at any time, by issuance of a written Change Order to this Agreement by the City Manager or designee -make changes, within the scope or period of performance of this Agreement. Consultant and the City Manager or designee shall negotiate an equitable adjustment, ff appropriate, in the terms of this Agreement to cover any such change. No payment for extras shall be made unless such are performed pursuant to a written Change Order. 8. Consultant shall obtain at Consultant's expense all necessary insurance in such form and amount as required by the City's Risk Manager before beginning work under this Agreement including, but not limited to, Workers' Compensation, Commercial General Liability, and all other insurance as required by the City, Including Professional Liability when appropriate. Consultant shall maintain such Insurance in full force and effect during the life of this Agreement. Consultant shall provide to the City's Risk Manager certificates of all insurances required under this section prior to beginning any work under this Agreement. The Consultant will ensure that all subcontractors comply with the above guidelines and will retain all necessary insurance in force throughout the term of this agreament. (a) Consultant will: 1. Provide materials From which to orient candidates to the selection process. 2. Develop exam content, administrative procedures, and instruction based on reference and materials that are supported by the job analysis and agreed upon by the city. This exam will include development of a written test to be administered by City staff on August 17, 2000; and a second component, which may be an oral review board, practical demonstration of sidne, or assessment center to be developed and administered by the consultant on August 24 and 25, 2000. d. Review any and all challenges to written test items and respond with a written decision on each challenge. 4_ Provide test administration guidance materials for each test component. This exam must be administered by August 27, 2000. We anticipate approximately 20 to 25 candidates to participate in the testing process. The process must follow the provisions set forth in the contract between the City of Tamarac and the International Association of Firefighters (IAFF). These provisions state that the testing process must include a written examination or a written portion of an assessment center. Other components of the process may include an assessment center, practical demonstration of skills, and/or an oral review board. Each component of the testing process will be valued at 100 points. Each component shall require a passing score of 70%. The final score shall be based on the total score of all components divided by the number of components. The written test will be drawn from not more than four (4) recognized Fire Rescue texts, the Tamarac Fire Rescue Department Operations Manual, and Rules and Regulations. A promotional list shall be compiled from the list of employees that earn a passing score on each component of the examination. This approach provides ample opportunities for interaction and information -gathering so the resulting exam processes will be highly defensible, effective, and tailored to meet the City's needs. Our methods will be designed to produce a practical and content valid examination process. Each project phase will contribute to the quality of the new examinations and to documentation that will be part of the content validity report. As your needs require, you can choose to have us conduct any or all of the phases listed below. Phase 1 - Job Analysis: Our approach involves on -site interviews and task inventories. The interviews are conducted with a small number of incumbents and their supervisors and lead to the development of a detailed task inventory. This time -efficient task inventory is administered to a significant sample of incumbents. The resulting data is extensively analyzed resulting in detailed job descriptions. These descriptions are the foundation for the content validity of the processes as they lead directly to specific exam plans that detail the test content and the modes of assessment for this content. Phase 2 - Test Development: We will develop the exam content, administrative procedures and instructions based on references and materials that are supported by the job analysis and agreed upon by the City including the Tamarac Fire Rescue Department Operations Manual and Rules and Regulations. The written exam may be expected to assess technical job knowledge (such as firefighting techniques, hazardous materials, and emergency response and care) through the use of at least 100 test questions. The written exam may also include assessment of supervisory knowledge. An oral examination will be developed to assess job dimensions such as supervision, leadership, interpersonal and oral communication skills, and community relations. It may employ both a brief presentation and several oral exam questions. The oral exam will use the well -accepted method of behaviorally based interviewing and will employ behaviorally based rating scales that we have found to provide highly reliable and valid oral exams. Darany and Associates makes every effort to ensure that candidates are provided with a fair opportunity to perform to the best of their ability in the test environment. This requires that candidates be aware of several details regarding the testing process. Therefore, materials to orient the candidates to the selection process will be provided. Such materials typically include a brief description of the test content areas and test format as well as test taking guidelines. Additionally, references used to develop the tests will be provided for distribution to the candidates early in each recruitment cycle. 0 Phase 3 - Test Administration: Test administration guidance materials will be provided for each test component. We will also provide orientation and training for the oral examination board. Darany and Associates will provide test materials and complete scoring of each test component and a composite or final score listing for the overall process. Scoring and analysis will be accomplished within 72 hours from the day the materials reach our office. Phase 4 - Periodic and Final Reports: Following Phase 1, we will provide the City with a job analysis and examination plan report. Throughout the course of the project we will provide the City a written monthly status report of the project activities. Finally, a test validation report will be provided. This report will document the content validity of the testing process including activities from each phase and relevant statistical information. City's Role: Darany and Associates will collaborate with the City throughout the test development and validation project. We would expect the City to participate in the project in the following ways: A. Provide preliminary job information such as class specifications, previous job analysis reports, previous announcements, and organization charts. B. Provide subject matter experts (SME's) for several information gathering sessions. C. Communicate with candidates regarding the exam announcement, job applications, test scheduling, and scoring notification. D. Administer task inventories to incumbents. E. Obtain three to four persons for the oral examination board. F. Administer the written and oral examinations. G. Provide facilities for job analysis and other meetings, and administration of the written test and oral examination. H. Assist in the coordination of Fire Department staff acting as SME's, etc. I. Administer all phases of processing following our scoring of the examinations (e.g., challenges, eligible list maintenance, and vacancy referrals). 4 COMPANY EXPERIENCE Since 1994, Darany and Associates has been providing public sector clients with professionally developed testing instruments for a wide range of job -classifications. Our firm has developed testing instruments for all levels of staff from entry level through management including written examinations, oral examinations, role-play exercises, public presentation exercises, and in -basket exercises. A substantial number of our examinations have been for fire service classifications and have included the assessment of both technical knowledge and more general skill areas such as leadership, oral and written communication skills, supervisory and management skills, interpersonal effectiveness, and problem solving. In most instances, examinations have been developed on the basis of large-scale job analysis and research projects and custom designed for the client jurisdiction. Our firm possesses an experience base which makes us uniquely qualified to meet the needs of the public sector agencies we serve. In addition to advanced academic training, all members of our firm have served in supervisory or management capacities in public sector agencies at local, state and federal levels of government. Ted Darany: Mr. Darany is President of Darany and Associates, a firm which he created to provide personnel and computer consulting services. He received his B.A. from the University of Michigan and his M.A. in Measurement and Statistics from Michigan State University. He served as the Employment Division Chief for San Bernardino County from 1978 to 1994. Previously, he was employed as a regional psychologist for the U.S. Civil Service Commission. Prior to that, he worked for the State of Michigan Department of Civil Service for ten years where he managed test development and research. He has taught MA and Ph.D. courses in testing, research methods and public administration at four universities. He won the 1987 Stephen E. Bemis Memorial Award of Excellence for Outstanding Achievement in Personnel Management. Jennifer French: Ms. French has extensive experience in the area of recruitment and selection based upon over 20 years of experience as a practitioner, supervisor and consultant in public sector personnel management. She has held management level positions which included responsibility for recruitment, testing, selection research, position classification and automation. She received her B.S. from Michigan State University and her M.A. in Measurement and Research Design from Arizona State University. From 1979 to 1994, she worked for San Bernardino County where she managed recruitment and selection, selection research, and quality control. Her previous experience includes test development and research with an Arizona public utility and the states of Michigan and Arizona. She has been elected to leadership positions in several professional organizations. Kristine Smith: Prior to joining Darany and Associates, Ms. Smith was employed by the County of San Bernardino where she was the Manager of Organizational and Employee Development and the Western Region Item Bank, a nation-wide testing consortium. Her experience includes work in job analysis, recruitment, test development and research, training, organizational development, and classification. She received her B.S. in Administration from the University of California, Riverside and her M.A. in Public Administration from California State University, San Bernardino. Additionally, she has obtained training in marketing and strategic planning from the American Management Association. She is a current member of the Board of Directors of the Personnel Testing Council of Southern California and of the International Personnel Management Association Assessment Council (IPMAAC). She is also the current President of IPMAAC. Christie Jacques: Ms. Jacques has been an analyst with Darany and Associates since 1994 and has been a team member on all of the firm's test research and development projects. Previously, she was the operations manager for the Examinations Division of San Bernardino County where she was responsible for test security and administration. She was also part of the management team responsible for system and process re -engineering.
