R-2000- c;40L A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO AMEND THE DEVELOPMENT ORDER FOR THE WESTPOINT DEVELOPMENT OF REGIONAL IMPACT (DRI) LOCATED IN SECTION 7, TOWNSHIP 49 SOUTH, RANGE 41 EAST AND APPROVED BY ORDINANCE NO.O- 89-44 ADOPTED DECEMBER 21, 1989, AND THEREAFTER AMENDED BY ORDINANCE NO, 0-94-20 ADOPTED NOVEMBER 9, 1994; AUTHORIZING A LIMITED AMOUNT OF DEVELOPMENT AND PROVIDING FOR AN EXTENSION OF BUILDOUT DATE FOR CERTAIN PARCELS; REAFFIRMING ORDINANCE NO. 0-89-44 AS AMENDED BY ORDINANCE NO. 0-94-20 EXCEPT AS AMENDED HEREIN; PROVIDING FOR RECORDATION IN ACCORDANCE WITH SECTION 380.06(15)(f) FLORIDA STATUTES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Ordinance No. 0-89-44, adopted on December 21, 1989, as thereafter amended by Ordinance No. 0-94-20, adopted on November 9, 1994, the City Commission of the City of Tamarac approved with conditions a Development Order for the Westpoint Development of Regional Impact (DRI) on the property described in Exhibit "A" of Ordinance No. 0-89-44 (attached hereto as Exhibit "B"); and WHEREAS, CM Illinois Investment Group has applied to the City of Tamarac for an amendment of the Development Order to authorize a limited amount of development on July 5, 2000 - Temp. Reso. #9080 2 Revision No. 1 - July 6, 2000 certain parcels within the Westpoint DRI and to provide for an extension of the buildout date for those same parcels; and WHEREAS, at its July 12, 2000 meeting the City Commission shall conduct the required public hearing; and WHEREAS, the City Commission has reviewed the proposed amendment pursuant to the criteria enumerated in Section 380.06(19) Florida Statutes and has determined that the proposed amendment does not constitute a substantial deviation from the approved Development Order in accordance with Section 380.06(19) Florida Statutes; and WHEREAS, the Director of Community Development recommends approval; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to authorize the appropriate City Officials to amend the Development Order for the Westpoint Development of Regional Impact (DRI) located in Section 7, Township 49 South, Range 41 East and approved by Ordinance No. 0-89-44 adopted December 21, 1989, and thereafter amended by Ordinance No. 0-94-20 adopted November 9, 1994; authorizing a limited amount of development and providing for an extension of the buildout date for certain parcels; reaffirming Ordinance No. 0-89-44 as amended by Ordinance No. 0-94-20 except as amended herein; providing for recordation in accordance with Section 380.06(15)(f) Florida Statutes. Reso. #9080 3 Revision No. 1 - July 6, 2000 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission authorize the appropriate City Officials to amend the Development Order for the Westpoint Development of Regional Impact (DRI) located in Section 7, Township 49 South, Range 41 East and approved by Ordinance No. 0-89-44 adopted December 21, 1989, and thereafter amended by Ordinance No. 0-94-20 adopted November 9, 1994; authorizing a limited amount of development and providing for an extension of the buildout date for certain parcels. SECTION 3: Section 6(R) of the Development Order for the Westpoint DRI, as amended, is hereby amended to read: (R) Commencement of Development. The deadline for commencing physical development at the site shall be one year from the effective date of this Development Order. For purposes of this paragraph, "physical development" means site preparation or development of any portion of the Site. The termination date for completing development shall be December 30, 1999; provided that the Developer, or his successors and assigns, complies with section 6.U. The termination date may only be modified in accordance with Section 380.06(19)(c), Florida Statutes. Notwithstanding the foregoing, on or before July 5, 2000 - Temp. Reso. #9080 4 Revision No. 1 - July 6, 2000 December 29, 2005, 1251000 square feet of industrial may be constructed on the parcel desi nated as Parcel 1 on the Revised Master Development Plan attached hereto as Exhibit "A" and 100,000 square feet of office may be constructed on the parcel designated as Parcel 2 on the Revised Master Development Plan attached hereto as FYhihit "A" SECTION 4: Except as amended herein, Ordinance No., 0-89-44, adopted December 21, 1989, as amended by Ordinance No. 0-94-20, adopted November 9,1994, is hereby ratified, reaffirmed and shall remain in full force and effect. SECTION 5: Within thirty (30) days of the effective date of this Resolution amending the Development Order for the Westpoint DRI, the Applicant shall record a notice of the adoption of an amendment to a development order in accordance with the provisions of Section 380.06(15)(f) Florida Statutes, and shall return a copy of such recorded document to the City. SECTION 6: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION is If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 1 L, 1 SECTION 8 passage and adoption.
