R-2000- Z/9 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, OPPOSING THE PROPOSED FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) CONSTRUCTION OF A TANDEM TRUCK STAGING AREA TO BE LOCATED ON THE SOUTHWEST CORNER OF THE COMMERCIAL BOULEVARD INTERCHANGE OF THE SAWGRASS EXPRESSWAY; PROVIDING FOR TRANSMITTAL TO FDOT AND THE BROWARD COUNTY BOARD OF COUNTY COMMISSIONERS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the State of Florida Department of Transportation (FDOT) is proposing to construct a Tandem Truck Staging Area and associated ramp improvements (attached hereto as Exhibit "A") to be located on the southwest corner of the Commercial Boulevard Interchange of the Sawgrass Expressway; and WHEREAS, the Tandem Truck Staging Area to be located on the southwest corner of the Commercial Boulevard Interchange of the Sawgrass Expressway is intended to replace an existing Tandem Truck Staging Area located at the Deerfield Plaza of the Sawgrass Expressway; and WHEREAS, on July 13, 2000 a public hearing was held by FDOT to discuss the proposed Tandem Truck Staging Area; and August 14, 2000 - Temp. Reso. #91 15 2 Revision No. 1 - August 16, 2000 1 WHEREAS, the Mayor of the City of Tamarac, the Director of Community Development, and representatives of the Public Works Department and Tamarac Division of the Broward Sheriffs Office (BSO) attended the July 13, 2000 meeting held by FDOT; and WHEREAS, upon review of the information discussed and provided at the July 13, 2000 meeting, the Director of Community Development has determined that the construction of the Tandem Truck Staging Area on the southwest corner of the Commercial Boulevard Interchange, as currently proposed by FDOT, will have the following impacts: 1) The construction of the proposed Tandem Truck Staging Area at the southwest corner of the Commercial Boulevard Interchange of the Sawgrass Expressway and subsequent elimination of the existing staging area located at the Deerfield Plaza of the Sawgrass Expressway will attract all Tandem Truck Traffic destined for locations in Broward County to the Commercial Boulevard Interchange, thereby, generating significantly increased levels of heavy truck traffic on Commercial Boulevard, not specifically destined for locations within the City of Tamarac. 2) The Increased levels of heavy truck traffic on Commercial Boulevard generated by the staging area may negatively impact the existing and future development along Commercial Boulevard within the City of Tamarac. Reso. #91 15 3 Revision No. 1 - August 16, 2000 3) The increased levels of heavy truck traffic on Commercial Boulevard may negatively impact the existing development within the Tamarac Commerce Park and impair the City's continuing economic development activities to attract new business to locate within the Tamarac Commerce Park. 4) The increased number of trucks entering and exiting the proposed staging area may create hazardous conflicts with the existing traffic as well as future traffic anticipated to be generated as a result of the City of Tamarac's continued economic development efforts relating to the Tamarac Commerce Park. 5) The proposed configuration of the staging area will require Tandem Trucks exiting the Staging Area to travel along Commercial Boulevard in order to proceed north on the Sawgrass Expressway which is against the law. 6) The storage of tractors equipped with refrigeration units awaiting delivery within the proposed Tandem Truck Staging Area will generate noise disturbances with adjacent properties. 7) The storage of trailers with valuable cargo awaiting delivery in an unsecured location will create a potential target for crime. 8) Based upon input received from representatives of the trucking industry, the proposed configuration of the Tandem Truck Staging Area will not be adequate to accommodate the current needs of the trucking industry. Reso. #91 15 4 Revision No. 1 - August 16, 2000 1 9) The construction of the proposed staging area is inconsistent with the Future Land Use Designation (Recreation and Open Space) as depicted on the Broward County Future Land Use Map. WHEREAS, the Director of Community Development and the Director of Public Works recommend approval of this Resolution; and WHEREAS, the City Manager recommends approval of this Resolution; and WHEREAS, the City Commission of the City of Tamarac, Florida is opposed to the proposed FDOT construction of a Tandem Truck Staging Area on the southwest corner of the Commercial Boulevard Interchange of the Sawgrass Expressway and desires to officially record its opposition with the Florida Department of Transportation and Broward County Board of County Commissioners. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. Reso. #91 15 5 Revision No. 1 -- August 16, 2000 SECTION 2: That the City Commission of the City of Tamarac, Florida, does hereby record its opposition to the FDOT construction of a Tandem Truck Staging Area on the southwest corner of the Commercial Boulevard Interchange of the Sawgrass Expressway. SECTION 3: That the City Clerk is hereby instructed to forward a copy of this resolution to the Florida Department of Transportation and Broward County Board of County Commissioners. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
