R-2000- oTAS" A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, TO APPROVE A DELEGATION REQUEST TO AMEND THE WESTPOINT SECTION 7 PLAT TO REDUCE THE MINIMUM DISTANCE FROM THE ULTIMATE RIGHT-OF-WAY LINE FROM HIATUS ROAD AT THE EXISTING RIGHT TURN -IN ONLY DRIVEWAY TO THE OUTER EDGE OF ANY INTERIOR SERVICE DRIVE OR PARKING SPACE WITH ACCESS TO THE DRIVEWAY FROM ONE -HUNDRED FEET (100') TO FIFTY FEET (50'), LOCATED AT THE NW CORNER OF HIATUS ROAD AND COMMERCIAL BOULEVARD; SPECIFICALLY PORTIONS OF TRACTS "B" AND "C" IN SECTION 7, TOWNSHIP 49 SOUTH, RANGE 41 EAST OF THE "WESTPOINT SECTION 7 PLAT", ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 162, PAGE 23 OF THE PUBLIC RECORDS OF BROWARD COUNTY IN THE CITY OF TAMARAC, FLORIDA; CASE NO. 6-P-00; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission has examined the application and staff recommendation dated August 23, 2000; and WHEREAS, the City Commission has determined that the application is in compliance with all elements of the Comprehensive Plan for the development that is the subject of the application; and WHEREAS, on February 8, 1995, the City Commission of the City of Tamarac, Florida adopted Resolution No. R-95-29 granting Development Order No. 293 and approving the "Westpoint Section 7 Plat"; and WHEREAS, at the time the plat was recorded, the City of Tamarac and Broward County June 29, 2000 - Temp. Reso. #9072 2 Revision No. 1 —August 7, 2000 did not have the benefit of a conceptual site plan for the property to utilize the determination of entrance openings; and WHEREAS, the property owner desires to amend the Westpoint Section 7 Plat to reduce the minimum distance from the ultimate right-of-way line from Hiatus Road at the existing right turn -in only driveway to the outer edge of any interior service drive or parking space with access to the driveway from one -hundred feet (100') to fifty feet (50'), located at the NW corner of Hiatus Road and Commercial Boulevard; specifically portions of Tracts "B" and "C" in Section 7, Township 49 South, Range 41 East of the "Westpoint Section 7 Plat", according to the Plat thereof as recorded in Plat Book 162, page 23 of the Public Records of Broward County in the City of Tamarac, Florida; Case No. 6-P-00; and WHEREAS, the Director of Community Development recommends approval; and WHEREAS, the Planning Board recommended approval on July 5, 2000; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to approve this Delegation Request. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. 1 June 29, 2000 - Temp. Reso. #9072 Revision No. 1 -- August 7, 2000 SECTION 2: That the City Commission hereby approves the Delegation Request to amend the Westpoint Section 7 Plat to reduce the minimum distance from the ultimate right-of-way line from Hiatus Road at the existing right turn -in only driveway to the outer edge of any interior service drive or parking space with access to the driveway from one -hundred feet (100') to fifty feet (50'), located at the NW corner of Hiatus Road and 3 Commercial Boulevard; specifically portions of Tracts "B" and "C" in Section 7, Township 49 South, Range 41 East of the "Westpoint Section 7 Plat", according to the Plat thereof as recorded in Plat Book 162, page 23 of the Public Records of Broward County in the City of Tamarac, Florida; Case No, 6-P-00. SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict.
