R-2000-232 Temp Reso #9130 Page 1 September 1, 2000 Revision #1 — 9/7/00 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING A REQUEST FROM LOWE'S TO WAIVE ALL PERMIT FEES FOR THE INSTALLATION OF HURRICANE SHUTTERS AT 7809 NW 71ST AVENUE AND 7619 NW 71ST AVENUE, TAMARAC, FL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac encourages all residents to prepare for hurricanes; and WHEREAS, the residents of the City of Tamarac are encouraged and expected to "shelter in place" in their own homes or those of friends and family; and WHEREAS, Lowe's Home Stores has a commitment to community involvement; and WHEREAS, Lowe's Home Stores is working in conjunction with the Tamarac Community Emergency Response Team (CERT) program and will provide shutters and installation for two homeowners in Tamarac; and 1 Temp Reso #9130 Page 2 September 1, 2000 Revision #1 — 9/7/00 WHEREAS, the permit fees for each home are estimated to be less than $100.00; and and WHEREAS, this fee alone would impose a hardship on the homeowners; WHEREAS, the Fire Chief and City Manager recommend the waiver of fees for this project; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the residents of the City of Tamarac to authorize the waiver of these permit fees. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. SECTION 2: The request for waiver of all permit fees for the installation of hurricane shutters at 7809 NW 71St Avenue and 7619 NW 715t Avenue, Tamarac, Florida is hereby approved. SECTION 3: All resolutions or parts of resolutions in conflict herewith are HEREBY repealed to the extent of such conflict. 1 1 1 Temp Reso #9130 Page 3 September 1, 2000 Revision #1 — 9/7/00 SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its passage and adoption. PASSED, ADOPTED AND APPROVED this 15t" day of September, 2000.
