R-2000- ;,S-t A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO RELEASE A PUBLIC IMPROVEMENT WARRANTY BOND IN THE FORM OF A SURETY BOND #5912074 FROM SAFECO INSURANCE COMPANY OF AMERICA, IN THE AMOUNT OF $143,779.88 FOR THE WATER DISTRIBUTION AND SEWAGE COLLECTION SYSTEM IMPROVEMENTS INSTALLED BY PULTE HOME CORPORATION FOR THE LAND SECTION 6 PHASE 1 PROJECT LOCATED BETWEEN MCNAB ROAD AND SOUTHGATE BOULEVARD WEST OF NW 108'h TERRACE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Pulte Home Corporation, has constructed the Land Section 6 Phase 1 Project and installed the Water Distribution and Sewage Collection System Improvements in accordance with the Site Plan approved by the City Commission on February 9, 1994; WHEREAS, the Water and Sewer Developer's Agreement accepted and v` executed by the City of Tamarac on February 15, 1994, requires Pulte Home Corporation to provide a one-year Warranty Bond to the City of Tamarac for the Land Section 6 Phase 1 Project Water Distribution and Sewage Collection System Improvements located between McNab Road and Southgate Boulevard west of NW 108'h Terrace (a copy of which is attached hereto in map form as "Exhibit 1 "); and Temp. Reso. #8615 August 29, 2000 2 WHEREAS, Pulte Home Corporation, has requested the release of a Public Improvement Warranty Bond in the form of a Surety Bond #5912074 from Safeco Insurance Company of America, in the amount of $143,779.88 (a copy of which is attached hereto as "Exhibit 2) for the Water Distribution and Sewage Collection System Improvements installed for the Land Section 6 Phase 1 Project; and WHEREAS, the Improvements were inspected, approved and are recommended for acceptance for City ownership by the Utilities Engineering Division; and WHEREAS, it is the recommendation of the Director of Utilities that the Public Improvement Warranty Bond be released for the Land Section 6 Phase 1 Project Water Distribution and Sewage Collection System Improvements; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to release the Public Improvement Warranty Bond in the form of a Surety Bond #5912074 from Safeco Insurance Company of America, in the amount of $143,779.88 from Pulte Home Corporation for the Land Section 6 Phase 1 Project Water Distribution and Sewage Collection System Improvements. 1 n 1 Temp. Reso. #8615 August 29, 2000 3 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. SECTION 2: The appropriate City Officials are hereby authorized to release the one-year Public Improvement Warranty Bond for the Water Distribution and Sewage Collection System Improvements in the form of a Surety Bond in the amount of $143,779.88 for the Water Distribution and Sewage Collection System Improvements installed by Pulte Home Corporation for the Land Section 6 Phase 1 Project located between McNab Road and Southgate Boulevard west of NW 10811 Terrace in accordance with Section 10-156 of the City Code. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or r� Temp. NOW, THEREFORE, the condition of this obligation Is such that if the said Principal, its successors, fcgal representatives or assigns shall have made all corrections and shall have paid all claims for the cost of correcting all insufficiencies in design, workmanship and/or materials discovered within one year of the date of formal acceptance of the Subdivision Improvements by the City Commission of the City of Tamarac, Florida, then this obligation shall be void; else to continue In full force and effect. Prior to the end of the calendar year following said City Commission's formal acceptance of the Subdivision Improvements warranted by this bond, the Director of Utilities or his designee shall inspect them for final release. If his investigation reveals any insufficiencies, then he shall notify the Principal, In writing, that the worts is unacceptable. The Principal and the Surety, jointly and severally, agree that said City of Tamarac shall have the right to correct insufficiencies in design, workmanship and/or material-$ in the avent the Principal should fall or refuse so to do within ninety (90) days after said written notice by the Director of Utifities, and, pursuant to public advertisement and receipt and acceptance of bids, cause said Insufficiencies In design, workmanship and/or materials to be connected, In such case, the Principal and Surety shell be jointly and severally liable hereunder to pay and Indemnify said City upon the correction of said Insufficiencies in design, workmanship and/or materials, the final total cost thereof, including but not limited 950814 2 Wsurety wPd to engineering, legal and contingent caGts together with any damage, direct or consequentlel, which said City of Tamarac may sustain on account of the failure of the Principal to comply with all of the requirements hereof.
