CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2000-274
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO APPROVE THE
WAIVER OF ENGINEERING FEE FOR THE
RECONSTRUCTION OF SEAWALL AT 9414 N.W. 72NO
STREET, TAMARAC, FLORIDA 33321; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the seawall at 9414 N.W. 72"d Street, Tamarac, Florida 33321,
collapsed between October 7, 2000 and October 8, 2000; and
WHEREAS, pursuant to Sec. 10-232 (g) of the Code of the City of Tamarac, Florida,
the property owner is responsible for maintenance of seawall; and
WHEREAS, the owners of the property, Walter J. Blythe and Kathryn Blythe,
requested the Mayor, Vice Mayor and Commissioner to waive the engineering permit fee,
the letter attached hereto as Exhibit 1; and

WHEREAS, limited access and stringent City standards make seawall restoration
and repairs expensive; and
WHEREAS, the seawall at 9414 N.W. 72"d Street must be reconstructed in its
entirety along with parts of adjacent seawalls; and
WHEREAS, Resolution R-99-250 authorizes the levy of engineering permit fees
pursuant to Section 10-159 (a) of the City Code; and
WHEREAS, Walter J. Blythe and Kathryn Blythe are an elderly couple, living on
fixed income; and
WHEREAS, reconstruction of the seawall on their property is already an enormous
financial burden on them; and
WHEREAS, the City has waived certain engineering fees in the past; and
WHEREAS, this waiver of engineering fee is being granted under exceptional
circumstances related to financial hardship due to the total collapse of seawall
accompanied by damage to the seawalls of the adjacent properties, and shall not set a
precedent; and
WHEREAS, it is the recommendation of the Director of Public Works that the
engineering fee for the seawall reconstruction at 9414 N.W. 72nd Street be waived; and

WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in
the best interest of the citizens and residents of the City of Tamarac to authorize the
appropriate City Officials to waive engineering fees for the seawall reconstruction at 9414
N.W. 72"d Street, Tamarac, Florida 33321.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this resolution.
SECTION 2: The appropriate City Officials are hereby authorized to waive
the engineering fee for reconstruction of the seawall at 9414 N.W. 72"d Street.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

This Resolution shall become effective immediately upon its

To: The Honorable Mayor, Joe Schreiber, Vice Mayor, Karen Roberts and City
Commissioners:
We are writing this letter at the suggestion of Mr. Burgio, as he has informed us that
there may be a possibility that the cost of the engineers permit for the construction of
our new sea wall might be waived.
This casualty has caused us so much stress, physically, psychologically and
financially, that it has been almost unbearable. The cost of the sea wall alone will be
$32.000.00 not Including repair to our neighbors lawns, repairing the fence the
sprinklers and any other expenses that may occur.
Mr. Schreiber, if you remember coming out to our place and viewing first hand the
damage that has occurred, you know what we are going through. At that time you told
us that you would do anything that you could for us. We understand that you people
have the power to waive this permit charge.
Thank you for considering this request, we would appreciate anything that you can do
for us.
