RESOLUTION NO. R-2000-277
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO ACCEPT A BILL OF
SALE ABSOLUTE FROM WEST POINT LAND, L.L.C., FOR
THE WATERMAINS, WASTEWATER PUMP STATION,
FORCEMAIN AND SEWAGE COLLECTION SYSTEM
IMPROVEMENTS FOR THE WEST POINT LAND SECTION 7
PROJECT LOCATED ON THE NORTH SIDE OF
COMMERCIAL BOULEVARD BETWEEN NOB HILL ROAD
AND SAWGRASS EXPRESSWAY, FOR CITY OWNERSHIP,
AUTHORIZING AND DIRECTING THE CITY CLERK TO
RECORD SAID DOCUMENT IN THE PUBLIC RECORDS OF - -
BROWARD COUNTY; PROVIDING FOR CONFLICTS; l
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, West Point Land, L.L.C., has constructed the West Point Land
Section 7 Project and has installed the watermains, wastewater pump station,
forcemain and Sewage Collection System Improvements in accordance with the
Engineering Plans approved by the Utilities Department on May 5, 1998, which is
located on the north side of Commercial Boulevard between Nob Hill Road and
Sawgrass Expressway (a copy of which is attached hereto in map form as "Exhibit 1 ");
and
WHEREAS, City Code Section 22-195(a), requires West Point Land, L.L.C., to
transfer a Bill of Sale Absolute to the City of Tamarac for the watermains, wastewater

pump station, forcemain and Sewage Collection System Improvements installed for the
West Point Land Section 7 Project; and
WHEREAS, West Point Land, L.L.C., has offered a Bill of Sale Absolute to the
City of Tamarac for the watermains, wastewater pump station, forcemain and Sewage
Collection System Improvements installed for the West Point Land Section 7 Project;
and
WHEREAS, the Improvements were inspected, approved and are recommended
for acceptance by the Utilities Engineering Division after a one-year warranty period;
and
WHEREAS, it is the recommendation of the Director of Utilities that the Bill of
Sale Absolute be accepted for the West Point Land Section 7 Project watermains,
wastewater pump station, forcemain and Sewage Collection System Improvements;
and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be
in the best interest of the citizens and residents of the City of Tamarac to accept a Bill
of Sale Absolute from West Point Land, L.L.C., for the watermains, wastewater pump
station, forcemain and Sewage Collection System Improvements installed for the West

Point Land Section 7 Project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
resolution.
SECTION 2: The appropriate City Officials are hereby authorized to
accept a Bill of Sale Absolute (a copy of which is attached hereto as "Exhibit 2") from
West Point Land, L.L.C., for the West Point Land Section 7 Project watermains,
wastewater pump station, forcemain and Sewage Collection System Improvements
located on the north side of Commercial Boulevard between Nob Hill Road and
Sawgrass Expressway.
SECTION 3: The City Clerk is hereby authorized and directed to record
said document in the public records of Broward County.
SECTION 4: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 5: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining portions or
applications of this Resolution.

Dear Mr. Poorman:
I am pleased to advise you that at its meeting on October 25, 2000, the Tamarac
City Commission approved a Resolution authorizing the appropriate City Officials to
accept a Bill of Sale Absolute from West Point Land, L.L.C., for the watermains,
wastewater pump station, forcemain and Sewage Collection System Improvements
installed for the West Point Land Section 7 Project, for City ownership; authorizing and
directing the City Clerk to record said document in the public records of Broward
County. The project is located on the north side of Commercial Boulevard between Nob
Hill Road and Sawgrass Expressway. Enclosed is a copy of the approved resolution for
your records.
Mr. Tony Rabbat, Utilities Engineer, will be your contact person with the City
concerning this matter. Please feel free to contact him at (954) 724-1271. However, if
there should be any problems of a serious consequence, I expect you to advise me
directly and immediately.
