R2000-284 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPOINTING TWO (2) REGULAR MEMBERS TO THE CONSUMER AFFAIRS COMMITTEE TO FILL UNEXPIRED TERMS ENDING JUNE 26, 2001; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission is desirous of appointing two (2) regular members to the Consumer Affairs Committee to fill unexpired terms ending June 26, 2001; and WHEREAS, in accordance with Section 2-107 of the Tamarac Code (attached hereto as Exhibit A) members of the Consumer Affairs Committee shall be appointed by the City Commission to serve one (1) year terms; and WHEREAS, the City Manager recommends approval; and WHEREAS, the City Commission of the City of Tamarac, deems it to be in the best interest of the citizens and residents of the City of Tamarac to appoint two (2) regular members to the Consumer Affairs Committee to fill unexpired terms ending June 26, 2001. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That pursuant to Section 2-107 of the Tamarac Code, the following people are hereby appointed as a members of the Consumer Affairs n u Temp. Reso. #9192 Page 2 October 23, 2000 Committee to fill unexpired terms ending June 26, 2001, or until such time as reappointments are made: Jerome Finnk Allan Smith SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. (Code 1975, § 2-5(a); Ord. No. 91-2, § 1, 2-27-91) Sec. 2-107. Membership; compensation; chairman. The members of the consumer affairs commit- tee shall be appointed by the city commission on an annual basis and serve at the pleasure of the city commission without compensation. The chair- man of the committee shall be appointed by the city commission. (Code 1975, § 2-5(c)) Sec. 2-108. Powers and duties. The consumer affairs committee shall be au- thorized to develop and activate programs de- signed for the protection of residents of the city in connection with purchases of residences, goods and services; receive and process consumer com- plaints and take or recommend necessary and appropriate action with respect thereto; recom- mend ordinances or resolutions designed to pro- tect consumers; cooperate with other similar gov- ernmental agencies; and perform such other similar duties as may be prescribed by resolution of the city commission, (Code 1975, § 2-5(b)) Sec. 2-109. Meetings. (a) The consumer affairs committee shall con- duct its meetings pursuant to Robert's Rules of Order, Newly Revised, and all applicable laws. A quorum shall consist of a majority of the member- ship, (b) The committee shall meet at teasq once a month at a regularly scheduled time which is to be approved by the city clerk. The committee may determine its own vacation period not to exceed more than two (2) cancelled meetings per year. (Code 1975, § 2-5(d), (e); Ord. The consumer affairs committee may have a commission liaison pursu- ant to the provisions of section 2-33. (b) Staff liaison. The consumer affairs commit- tee may have a staff person assigned to it by the city manager to serve in an advisory capacity. Any requests on the part of the committee for infor- mation or services from the administration shall be made by the chairman of the committee to the city manager or through the staff liaison if one is assigned. (Code 1975, § 2-5(f), (g)) Sec. 2-111. Vacancies. (a) Removal of members. A consumer affairs committee member appointed by the city commis- sion serves at the pleasure of the commission and shall be removed at any time by majority vote of the city commission. (b) Resignation of members. A resignation by a committee member made either orally or in writ- ing will be deemed accepted by the city commis- sion when the committee member announces his resignation to the committee, city manager or city commission. The city commission need not take any formal action to accept the resignation. Fail- ure to attend three (3) consecutive meetings with- out being excused by the chairman shall be deemed a resignation. INSURANCE ADVISORY \ BOARD* Sec. 2.136. If a regular mem- ber is nable to attend a meeting of the board, an alterna member may, with the approval of the chairm , take the place of the regular member at that m eting. For the duration of that meeting, such alter ate member shall have all the rights and duties ccorded a regular member. (Code 1975, ' 2-33(a); Ord. No regular or alternate member hall be directly or actively engaged as an emp oyee, officer, board member, consultant or repre ntative of any organization doing business with he city in the field of insur- ance. (Code 1975, § 2-33(c); Ord. No. 94-1, § 3, 1-26-94) Sec. 2-138. Powers And duties. The insurance adviso board shall be respon- sible to assist the city c mmission and adminis- tration when requested o matters pertaining to the city's insurance requi ements under the law. Upon request of the city mmission or the city manager or his designee, t e board shall formu- late advisory opinions on sp cific issues affecting the city's insurance requirem nts. The board shall have no administrative autho 'ty and shall not be directly involved in the actu 1 procurement of specific insurance policies. (Code 1975, § 2-33(b)) Sec. 2-139. Meetings.
