CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2000- 30
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA ACCEPTING A QUIT CLAIM DEED
FROM BROWARD COUNTY, FLORIDA, OF COUNTY -
OWNED PROPERTY, LOCATED IN TAMARAC, FLORIDA,
ACQUIRED BY THE COUNTY BY VIRTUE OF THE
PROPERTY BEING DELINQUENT AD VALOREM TAX
PAYMENTS LANDS; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the property legally described as:
"FORT LAUDERDALE TRUCK FARMS," (4-31 B)

TR 15 N 5', Less Pt. Desc. in O.R. Book 5389, Page 415.
SUBJECT TO ALL EXISTING PUBLIC PURPOSE, UTILITY AND
GOVERNMENT EASEMENTS AND RIGHTS OF WAY.
located in the City of Tamarac, Florida has escheated to Broward County, Florida as a
result of delinquent ad valorem tax payments; and
WHEREAS, Fla. Stat. §197.592, requires land acquired by a county for delinquent
ad valorem tax payments to be conveyed to the municipality in which it is located, free of
any liens of record; and
WHEREAS, Broward County, Florida has recorded a Quit Claim Deed for the
transfer of the above -described property to the City of Tamarac, Florida, a copy of the
recorded Quit Claim Deed is attached hereto as Exhibit 1; and

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to accept the Quit
Claim Deed from Broward County, Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA-
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the City Commission hereby accepts the Quit Claim Deed
(attached hereto as Exhibit 1) of the property legally described as:
"FORT LAUDERDALE TRUCK FARMS," (4-31 B)

SUBJECT TO ALL EXISTING PUBLIC PURPOSE, UTILITY AND
GOVERNMENT EASEMENTS AND RIGHTS OF WAY.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid,
in part or application, it shall not affect the validity of the remaining portions or applications
of this Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.

Tamarac, a Florida municipal corporation (the "GRANTEE"), whose post office address:

WITNESSETH:
That GRANTOR for and in consideration of good and valuable consideration, the
receipt and sufficiency whereof is hereby acknowledged, has granted, bargained and sold

A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF BROWARD COUNTY, FLORIDA,
APPROVING THE CONVEYANCE TO BROWARD COUNTY
MUNICIPALITIES OF COUNTY -OWNED PROPERTY WHICH
WAS ACQUIRED BY VIRTUE OF THE PROPERTY BEING
DELINQUENT TAX LANDS; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Broward County acquired title to real property, which is described in the
proposed Quit Claim Deeds attached hereto and made a part hereof as Exhibit "A,"by virtue
of delinquent ad valorem tax payments in accordance with the law; and
10 WHEREAS, the County, at its discretion, has decided not to sell or dedicate this land;
and

12 WHEREAS, the former owners of these lands have not filed a verified application or
13 petition with the Broward of County Commissioners seeking the restitution of this property
14 in the manner prescribed by Florida Statutes 197.592; and
15 WHEREAS, Florida Statutes 197.592 provides that lands acquired under this statute,
16 which the Board has determined are not to be conveyed to the record fee simple owner in
17 accordance with the applicable provisions of this statute, which are located within the
1$ boundaries of an incorporated municipality, shall be conveyed to the governing board of the
19 municipality in which the land is located; NOW, THEREFORE,
21 BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF BROWARD
COUNTY, FLORIDA:
Section 1. The recitals set forth in the preamble to this Resolution are incorporated
by reference herein.
25 Section 2, The conveyance of this property is hereby approved for good and

sufficient consideration.

27 Section 3. This property, having been acquired as County delinquent ad valorem tax
28 lands, and not having been previously sold or dedicated by the Board, and the former owner
29 not having requested by verified application a return of such property, the conditions set
30 forth in Section 197.592, Florida Statutes, for conveying this property are satisfied.
31 Section 4. The Chair of the Board of County Commissioners is hereby authorized to
32 execute the deeds attached hereto as Exhibit "A," and such other attached documents, if

any, as needed to effect the conveyances.

1 Section 5. The land conveyed shall be freely alienable by the municipalities without
2 regard to third parties, and liens of record currently held by the County on this parcel shall
not survive this conveyance.
This Resolution shall become effective upon its adoption.
