HomeMy WebLinkAboutCity of Tamarac Resolution R-2000-334Temp Reso. # 9020 - June 28, 2000 Revision #2 - October 19, 2000 Page 1 CITY OF TAMARAC, FLORIDA RESOLUTION NO, R-2000- 3.3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE A CONTRACT SERVICE ARRANGEMENT AGREEMENT WITH BELL SOUTH TELECOMMUNICATIONS, INC. CONVERTING THE EXISTING MEGALINK AND MEGALINK CHANNEL COMMUNICATION SERVICE (ML/MLCS) AT CITY HALL TO PRIMARY RATE ISDN (PRI) SERVICE AT A COST OF $1,150.15 PER MONTH FOR A PERIOD OF FORTY NINE MONTHS PLUS THE COST OF INSTALLATION IN THE AMOUNT OF $92.00; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the existing Megalink and Megalink Channel Communication Service (ML/MLCS) service for City Hall was approved by the City Commission on June 1998 at a cost of $1,752.69 per month to provide telecommunication services; and WHEREAS, the Primary Rate ISDN (PRI) service is the newest offering from Bellsouth for digital telecommunications needs; and WHEREAS, upgrading to PRI service will provide the City with a monthly savings of $602,54 in addition to enhanced features such as Caller ID; and WHEREAS, the PRI agreement (contract service arrangement agreement) attached hereto as Exhibit "A" contains a non -appropriations clause allowing the City to terminate this contract in the event that the funds for this service are not appropriated; and WHEREAS, the Director of Information Technology and the Purchasing and Contracts Manager recommend that the City upgrade to PRI service in City Hall for its telecommunication needs; and 1 Temp Reso. # 9020 - June 28, 2000 Revision #2 - October 19, 2000 Page 2 WHEREAS, funding for this service is available in the appropriate telephone/ telecommunications accounts; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to execute the contract service arrangement agreement with Bell South Telecommunications, Inc. to upgrade to PRI service at the City Hall at a cost of $1,150.15 per month. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and is hereby made a specific part of this Resolution. SECTION 2: Appropriate City Officials are hereby authorized to execute the contract service arrangement agreement from Bell South Telecommunications Inc. attached hereto as Exhibit "A" to upgrade to PRI service at a cost of $1,150.15 per month plus one time cost of installation in the amount of $92.00. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. ��:f"Nr•1Lqs.1 passage and adoption. ("Company") provide BellSouth' Primary Rate ISDN "PRI" at the 954/724 central office and/or Subscriber's location(s) at 7525 N.W. 88 Avenue, Tamarac, FL and 8601 W. Commercial Blvd., Tamarac, FL 1. The Company will furnish, maintain and provide maintenance of channel services for PRI in accordance with the Company's lawfully filed tariffs. The tariffs provide the basis for this Agreement with the Subscriber. The Agreement period shall begin the day PRI service is installed. 2. The Subscriber agrees to pay Company for the provision of PRI ("Service"), The Service shall be offered for variable rate periods of 24 to 72 months. This monthly rate will continue for the elected service period and will not be subject to Company initiated change during such period. 3. Recognition of previous service will be given to the Subscriber who renews an existing contract arrangement, for the same or larger system(s) and all associated rate elements at the same location(s), provided that the length of the new contract arrangement is a minimum 24 month service period or equals/exceeds the remaining service period of the original contract arrangement, whichever is greater. 4. Recognition of previous service will be given to the month -to -month Subscriber with a service date of January 1, 1994 or later who converts to a contract arrangement, provided the minimum service period has been met. For the Subscriber whose service date is January 1, 1994 or earlier, recognition will be given for the previous service back to January 1, 1994. For the Subscriber whose service date is later than January 1, 1994, recognition for the previous service will be given back to the actual service date. 5. The customer must accept service within 45 calendar days after the original service date or choose one of the following options: The service order shall be cancelled and appropriate cancellation charges will apply or billing will commence on the 46°i day beyond the original service date of the service order.�� /�� Si ure/ ` Date Printed Na e Title Page 1 6. The service period for this Agreement shall be 49 months. This Agreement period includes -- months for recognition of previous service. Name Title Page 2 8. At the expiration of the service period, the Subscriber may continue the Service according to renewal options provided under the tariff. If the Subscriber does not elect an additional service period, or does not request discontinuance of service, then the above Service will be continued at the monthly rate currently in effect for month - to -month rates. Service periods may also be renewed prior to expiration in accordance with regulations and rates in effect. 9. Suspension of service is not permitted for PRI service. 10. The Subscriber agrees to pay any added costs incurred by the Company due to a Subscriber initiated change in the location of the PRI service prior to the time it is placed in service. 11. Subject to the current provisions of applicable tariffs, the Subscriber may arrange to have existing Service under this Agreement moved within the same premises. Subscriber agrees to pay a non -recurring charge based upon the estimated cost of such arrangement without interruption or change in monthly rates. 12. Service may be transferred to another Subscriber at the same location upon prior written concurrence of the Company. The new Subscriber to whom the Service is transferred will be subject to all tariff provisions and equipment configurations currently in effect for the present Subscriber. This Agreement is effective when executed by the Subscriber and accepted by the Company, and is subject to and controlled by the provisions of the Company's lawfully filed tariffs, including any changes therein as may be made from time to time. If the City fails to appropriate or authorize the expenditure of sufficient funds to provide the continuation of this contract or if a lawful order issued in or for any fiscal year during the term of the contract reduces the funds appropriated or authorized in such amounts as to preclude making the payments set out therein, the contract shall terminate on the date said funds are no longer available without any termination charges or other liability incurring to the City. The City shall provide BellSouth with notice not less than thirty (30) days prior to the date of cancellation if such time is available. Otherwise, prompt notice will suffice. In the event of occurrence of the circumstances described immediately above, BellSouth shall not prohibit or otherwise limit the City's right to pursue and contract for alternate solutions and remedies as deemed necessary by the City for the conduct of its affairs. All provisions stated herein shall apply to any amendment or the execution of any option to extend the contract.
