RESOLUTION NO. R-2000- -33.5
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, GRANTING A
VACATION OF EASEMENT OF A UTILITY AND
DRAINAGE EASEMENT WITHIN THE MAINLANDS
OF TAMARAC LAKES UNIT FIFTEEN PLAT
LOCATED AT THE SOUTHEAST CORNER OF
MCNAB ROAD AND BROOKWOOD BOULEVARD;
SPECIFICALLY ALL OF LOT 1, LESS THE NORTH 2
FEET THEREOF, AND THE WEST 75 FEET OF LOT
2, BLOCK 248, LESS THE NORTH 2 FEET
THEREOF, OF THE "MAINLANDS OF TAMARAC
LAKES UNIT FIFTEEN" PLAT, ACCORDING TO THE
PLAT THEREOF AS RECORDED IN PLAT BOOK 71,
PAGE 3 OF THE PUBLIC RECORDS OF BROWARD
COUNTY, FLORIDA; CASE NO. 10-P-00; PROVIDING
FOR CONFLICTS; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Easement described in Exhibit "1" was dedicated to the public on
May 8, 1970 at the time of the initial recordation of the Plat; and
WHEREAS, the property owner, Thomas E. Lomax, has determined that the
existing utility and drainage easement is no longer needed due to the design layout for the
construction of an 8,000 square foot office building on the site; and
WHEREAS, the City Engineer and franchised Utility Companies have been
contacted and all have stated no objection to the vacation of a utility and drainage
easement located within the Mainlands of Tamarac Lakes Unit Fifteen Plat to facilitate any
future improvements; and
WHEREAS, the Director of Community Development recommends approval of this

vacation of easement; and

WHEREAS, the Planning Board recommended approval on November 15, 2000;
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to grant the vacation
of easement of a utility and drainage easement within the Mainlands of Tamarac Lakes
Unit Fifteen Plat located at the southeast corner of McNab Road and Brookwood
Boulevard; specifically all of Lots 1, less the north 2 feet thereof, and the west 75 feet of
Lot 2, Block 248, less the north 2 feet thereof, of the "Mainlands of Tamarac Lakes Unit
Fifteen" Plat, according to the Plat thereof as recorded in Plat Book 71, Page 3 of the
Public Records of Broward County, Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the vacation of easement of a utility and drainage
easement within the Tamarac Lakes Unit Fifteen Plat (described in Exhibit "1" attached
hereto) located at the southeast corner of McNab Road and Brookwood Boulevard;
specifically all of Lots 1, less the north 2 feet thereof, and the west 75 feet of Lot 2, Block
248, less the north 2 feet thereof, of the "Mainlands of Tamarac Lakes Unit Fifteen" Plat,
according to the Plat thereof as recorded in Plat Book 71, Page 3 of the Public Records of

Broward County, Florida; Case No. 10-P-00; is hereby granted.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.

A Parcel of land being a portion of that certain Strip 10 feet in width
reserved for Public Utilities and Drainage Easement, said Strip being the
East 5 feet of Lot 1 and the West 8 foot of Lot 2. Block 248, The
Mainlands of Tamarac Lakes Unit fifteen, according to the plat thereof
recorded in Plat Book 71, Page 3 of the Public Records Of Broword County,
Florldo, (said Strip being more particularly described in those certain Notes
shown on shut 1 of 2 of said Plot), the centetiine of said Strip being
more particularly described as Wows:
Commence at the Southwest Corner of said lot 1:
Thence S,89'02'49"E., along the South line of said Block 248, a distance of
181.64 feet, to a point an the common lot line between said Lots 1 and 2:
