R-2000- SV A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO ACCEPT AND EXECUTE A "TAMARAC IRRIGATION EASEMENT" WITH LENNAR LAND PARTNERS, FOR THE SOUTHAMPTON PROJECT, LOCATED ON THE WEST SIDE OF NOB HILL ROAD AT NW 77T" STREET, TO ALLOW LEGAL ACCESS BY CITY PERSONNEL FOR MAINTENANCE OF THE IRRIGATION SYSTEM; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the development of the Southampton Project requires the installation of the irrigation system; and WHEREAS, pursuant to City Code Section 11-8(d)(1), an irrigation system is required to be constructed to serve the swale adjacent to this project within the public right- of-way; and WHEREAS, an easement is required by City Code Section 22-191 for the irrigation water distribution system; and WHEREAS, Lennar Land Partners, as the developer of the property, has offered the "Tamarac Irrigation Easement" for irrigation water distribution; and WHEREAS, it is the recommendation of the Director of Public Works that this easement be accepted and executed for the Southampton Project; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to accept and execute C:\WINDOWS\TEMP\8896RES-Southampton Irrigation Easement.doc January 11, 2000 - Temp. Reso. #8896 Page 2 of 3 a "Tamarac Irriaation Easement" with Lennar Land Partners. for the Southampton Proiect_ required for the installation, maintenance and operation of the Irrigation water distribution system. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. Section 2: The appropriate City Officials are hereby authorized to accept and execute a "Tamarac Irrigation Easement" (attached hereto as "Exhibit 1 ") with Lennar Land Partners, for the Southampton Project, located on the west side of Nob Hill Road at NW 77th Street, to allow legal access by City Personnel in performing their duties, including maintenance and operation of the irrigation system. Section 3: That the City Clerk is hereby authorized and directed to record said agreement in the Public Records of Broward County. Section 4: That all Resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. NOW, THEREFORE, in consideration of the mutual covenants, promises and conditions contained in this agreement, and for the sum of Ten and No/100 Dollars ($10.00) and other good and valuable considerations, the receipt and sufficiency of which are hereby acknowledged, the parties hereto agree as follows: Recitals, The Recitals set forth above are true and correct and are incorporated herein. 2. Ca=. Grantor hereby grants to Grantee a nonexclusive easement to operate, repair and maintain the Irrigation System upon, across, under or above the Easement Area. 3. Easement Area. The Easement Area shall be limited to the area described in Exhibit A. 4, Right to Enter, Grantee shall have the right to enter upon Easement Area of Grantor at reasonable times and in a reasonable manner so as to perform any such maintenance, repair, replacement or removal of the Irrigation System. 5. Restnr, tom, Grantee agrees to promptly restore the Easement Area to the original condition it was in immediately prior to any such installation, maintenance, replacement or removal of the Irrigation System in the event the property of Grantor is hereby damaged. 6. Indemnificatiou. Grantor and Grantee shall indemnify, hold harmless and defend each other from and against any and all claims, demands, actions, losses, suits, damages and expenses and judgments that the other may suffer, incur or sustain or for which said other party may become liable because of the violation of any laws, ordinances or governmental regulations or because of injuries to or death of any person or persons, including employees of Grantor or Grantee or damages to or loss ..00MMPC00051ZKV702014 1999109107, 05.33 pm • • of property arising; out of or caused directly or indirectly in whole or in part from Grantor's or Grantee's (including; their respective employees, invitees and licensees) use of the Easement Area. 7, Rescrvation of Ri1~hts. Grantor reserves all rights not herein granted pursuant to this Easement, including but not limited to, the right of free ingress and egress over and upon the servient estate and to grant further casements under, over and on the Easement Area; provided that, in no event shall any of the rights herein reserved impede the easement herein granted. 8. Removal. In the event Grantee permanently removes said Irrigation System, this Easement shall automatically terminate. 9. Covenants Running with the Land. This Easement, rights, covenants and reservations contained herein shall run with the land and it shall inure to and be binding upon the respective successors and assigns of the parties hereto. This easement shall not be released or altered without consent of the Grantee and Grantor.
