CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2000- .,5'� _
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA SUPPORTING THE
SETTLEMENT OF THE WORKERS' COMPENSATION
AND OTHER CLAIMS OF SANDRA CUCUZZA FOR
$35,000 WITH ALL FUNDS PROVIDED BY THE FLORIDA
LEAGUE OF CITIES; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, on April 27, 1998, Sandra Cucuzza, an employee of the City of
Tamarac, while working as a maintenance worker, claimed she injured her back while
pushing debris out of a truck, and
WHEREAS, the Florida League of Cities denied Ms. Cucuzza's claim due to a
pre-existing back condition; and
WHEREAS, as part of this settlement, Ms. Cucuzza agrees to dismiss her
allegations of sex discrimination and ADA claims, which the City has investigated and
found such claims to be unsubstantiated; and
WHEREAS, the City, along with it's insurance carrier, the Florida League of
Cities, agrees that it is in the best interest of the City of Tamarac to settle all claims for
the amount of $35,000, considering the possible costs of defense and the possibility of
an adverse judgement in any or all of the claims; and
WHEREAS, a mediation conference was held on December 23, 1999, with all
parties represented, and the settlement amount was agreed to; and

WHEREAS, all funds for the settlement are paid by the Florida League of Cities;
WHEREAS, the Risk Manager recommends approval; and
WHEREAS, within the settlement is monetary consideration for all claims made.
WHEREAS, the City Commission of the City of Tamarac deems it to be in the
best interests of the citizens and residents of the City of Tamarac to authorize the
appropriate City Officials to support the settlement of the Workers' Compensation claim
of Sandra Cucuzza for $35,000 with all funds provided by the Florida League of Cities.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA,
Section 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
Resolution.
Section 2: The City Commission of the City of Tamarac supports a $35,000
settlement with Sandra Cucuzza for all claims against the City in return for a full release
of all claims.
Section 3: That all resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
Section 4: If any clause, sections, or other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid,
in part or application, it shall not affect the validity of the remaining portions or
applications of this Resolution.

Section 5: This Resolution shall become effective immediately upon adoption.
