R-2000- 64ti A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, SUPPORTING FLORIDA HOUSE BILL 501 AND FLORIDA SENATE BILL 756; DIRECTING THE CITY CLERK TO SEND A COPY OF THIS RESOLUTION TO THE BROWARD COUNTY LEGISLATIVE DELEGATION FOR CONSIDERATION DURING THE 2000 LEGISLATIVE SESSION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the health, safety and welfare of the residents and employees of the City of Tamarac is a foremost concern of the City Commission of the City of Tamarac; and WHEREAS, the Florida State legislature has before it House Bill 501 (attached hereto as Exhibit 1) and Senate Bill 756 (attached hereto as Exhibit 2) for consideration during the 2000 Florida Legislative Session; and WHEREAS, House Bill 501 and Senate Bill 756 would allow local governments to regulate the possession of firearms on public property and by public employees during work hours by ordinance or resolution, so long as such regulation is properly posted; and WHEREAS, regulating the possession of firearms on public property and by public employees during work hours would enhance the health, safety and welfare of the residents and employees of the City of Tamarac; and WHEREAS, the City Manager recommends the City Commission support House Bill 501 and Senate Bill 756; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to support House Bill 501 and Senate Bill 756. Reso # 8935 - February 28, 2000 Page 2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. Section 2: The City Commission of the City of Tamarac supports Florida House Bill 501 and Florida Senate Bill 756, pending for consideration in the 2000 Florida Legislative Session. Section 3: The City Clerk is directed to send a copy of this resolution to the Broward County Legislative Delegation for consideration during the 2000 Florida Legislative Session. Section 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 5: If any clause, section, other part of application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this Resolution. 1 Temp. Reso. # 8935 Florida House of Representatives - 2000 By Representative Sobel A bill to be entitled An act relating to regulation of firearms; amending S. 790.33, F.S., relating to state preemption of the field of regulation of firearms and ammunition; providing that certain ordinances, resolutions, rules, or regulations of local government are not precluded with respect to possession of weapons or firearms of public employees or possession of weapons or firearms on public property controlled by local government, under specified circumstances; providing an exception for certain street, road, or highway rights -of -way; providing an effective date. Subsection (4) is added to section 790.33, Florida Statutes, to read: 790.33 Field of regulation of firearms and ammunition preempted.-- (4) LOCAL REGULATION OF FIREARM POSSESSION BY PUBLIC EMPLOYEES OR ON PUBLIC PROPERTY. -- (a) Nothing in this section shall preclude any ordinance, resolution, rule, or regulation of any local government acting as _an employer which regulates or prohibits the 2ossession of weapons or firearms of public employees on the job, or areas related thereto, during working hours, or during times related thereto.
