R-2000-71 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, DECLARING THE RESULTS OF THE REFERENDUM ELECTION VOTING AT THE MARCH 14, 2000 ELECTION ON AMENDMENTS TO THE CITY CHARTER: ORDINANCE NO. 0-99-10, (SECTION 6.03) - REDISTRICTING TO BE BASED UPON CURRENT POPULATION, ORDINANCE NO. 0-99-21, (SECTION 4.08) - CREATION OF CERTAIN BOARDS TO BE BY RESOLUTION, ORDINANCE NO. 0-99- 22, (SECTION 6.03) - REDISTRICTING COMMITTEE MEMBERS' REPRESENTATION BY DISTRICT AND AT -LARGE WITH APPOINTMENT BY MAYOR AND COMMISSION, ORDINANCE NO. 0-99-23, (SECTION 6.04) - ELECTION OF CHARTER BOARD MEMBERS BY DISTRICT, ORDINANCE NO. 0-99-24, (SECTION 7.04) - ELIMINATION OF SECTION 7.04 OF THE TAMARAC CHARTER, ORDINANCE NO. 0-99-25, (SECTION 7.08) - ELIMINATION OF YEARLY DEPOSITORY DESIGNATION REQUIREMENT, ORDINANCE NO. 0-99-26 (SECTION 7.11) - COMPETETIVE BIDS REQUIRED FOR AMOUNTS EXCEEDING TWENTY- FIVE THOUSAND DOLLARS, ORDINANCE NO. 0-99-27, (SECTION 8.01) -NUMBER OF TERMS A CHARTER BOARD MEMBER MAY SUCCEED THEMSELVES INCREASED FROM 1 TO 2, ORDINANCE NO. 0-99-28, (SECTION 8.01) - LENGTH OF TERM AND ELECTION OF CHARTER BOARD MEMBERS, ORDINANCE NO. 0-99-35, (SECTION 4.04) - COMMISSION EXPENSES TO BE SET THROUGH ANNUAL BUDGET PROCESS, ORDINANCE NO. 0-2000-03 (SECTION 4.04) - COMMISSION SALARIES TO BE SET THROUGH ANNUAL BUDGET PROCESS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a Referendum Election was held on March 14, 2000, wherein the electorate was asked to vote on amendments to the Charter of the City of Tamarac; and WHEREAS, the Broward County Canvassing Board has canvassed the results of the machine voting and absentee ballots and has certified such results to the City Clerk of 2 Temp. Reso. #8947 March 15, 2000 Revision #1, March 16, 2000 the City of Tamarac; and WHEREAS, the City Clerk has reviewed the certification from the Broward County Canvassing Board and has presented their findings to the City Commission for a formal Certification and Declaration of the results; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interests of the citizens and residents of the City of Tamarac to declare the results of the Referendum Election voting at the March 14, 2000 election on amendments to the City Charter: Ordinance No. 0-99-10, (Section 6.03), Ordinance No. 0-99-21, (Section 4.08), Ordinance No. 0-99-22, (Section 6.03), Ordinance No. 0-99-23, (Section 6.04), Ordinance No. 0-99-24, (Section 7.04), Ordinance No. 0-99-25, (Section 7.08), Ordinance No. 0-99-26, (Section 7.11), Ordinance No. 0-99-27, (Section 8.01), Ordinance No. 0-99- 28, (Section 8.01), Ordinance No. 0-99-35, (Section 4.04) and Ordinance No. 0-2000-03, (Section 4.04). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the following is hereby certified and declared as the official results of the public vote at the Referendum Election of March 14, 2000, for the proposed Charter Amendments: 1 3 Temp. Reso. #8947 March 15, 2000 Revision #1, March 16, 2000 ORDINANCE NO. 0-99-10 Amendment to Section 6.03 of the City Charter, redistricting to be based upon current population. Yes: 7,250 No: 2,635 ORDINANCE NO. 0-99-21: Amendment to Section 4.08 of the City Charter, creation of certain boards to be by Resolution. Yes: 6,930 No: 2,580 ORDINANCE NO, 0-99-22: Amendment to Section 6.03 of the City Charter, Redistricting Committee members' representation by district and at -large with appointment by Mayor and Commission. Yes: 6,409 No: 3,033 ORDINANCE NO. 0-99-23: Amendment to Section 6.04 of the City Charter, election of Charter Board Members by District. Yes: 7,840 No: 1,717 1 4 Temp. Yes: 5,809 No: 3,914 ORDINANCE NO. 0-2000-03: Amendment to Section 4.04 of the City Charter, Commission salaries to be set through annual budget process. Yes: 5,737 No: 4,074 SECTION 2: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 3: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 1 6 Temp.
