Reso. #8940 March 2, 2000 Page 1 CITY OF TAMARAC, FLORIDA RESOLUTION NO, R-2000- 7S A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE OFFICIALS TO REFUND A PERFORMANCE BOND PAID TO THE CITY BY COLUMBIA UNIVERSITY HOSPITAL IN THE AMOUNT OF $29,018.02; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac requires the person, developer, owner contractor or subcontractor who applies for a building permit to furnish to the City a good and sufficient bond; and WHEREAS, the contractor, subcontractor or other person having obtained a permit is responsible for the project until such work is approved by the City through its designated agent, City Engineer and City Building Official; and WHEREAS, Columbia University Hospital was the proposed developer of an Assisted Living Facility which required a performance bond for public improvements; and WHEREAS, Columbia University Hospital has abandoned this project and the City through its designated agent, and City Engineer have no record of outstanding issues for this project which would prohibit the release of said performance bond; and 1 1 1 1 Temp. Reso. #8940 March 2, 2000 Page 2 WHEREAS, Columbia University Hospital has requested the refund of said performance bond; and WHEREAS, the performance bond is in the form of cash; and WHEREAS, the Revenue Specialist in the Finance Department has confirmed that the City received and is in possession of said bond in the amount of $29,018.02; and WHEREAS, the City Manager and Director of Finance recommend the refund of this performance bond; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to authorize the appropriate City Officials to refund the performance bond payment. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The appropriate City Officials are hereby authorized to refund the performance bond payment paid to the City by Columbia University Hospital in the amount of $29,018.02 after the City receives the signed and notarized Indemnification, Hold Harmless and Release Form for the project. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. i] E Temp. Reso. #8940 March 2, 2000 Page 3 SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its passage and adoption.
