RESOLUTION NO. R-2000-2c�-
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO EXECUTE A QUIT
CLAIM DEED FROM THE CITY OF TAMARAC TO
BROWARD COUNTY GRANTING ADDITIONAL RIGHT-
OF-WAY FOR A PROPOSED TURN LANE ON
COMMERCIAL BOULEVARD NEAR THE SENIOR &
COMMUNITY CENTER; REPEALING RESOLUTION
NO. R-2000-19 DUE TO AN ERROR IN THE LEGAL
DESCRIPTION PREPARED BY THE SURVEYOR;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, as part of the construction of the Senior & Community Center, the
City of Tamarac intends to construct a turn lane into the Senior & Community Center
to provide for safe and efficient vehicular travel; and
WHEREAS, Broward County has requested the City to convey a parcel of land
generally located on the north side of Commercial Boulevard, east of Pine Island
Road, as part of the Senior & Community Center site, located at 8601 West
Commercial Boulevard, more particularly described in "Exhibit A" for use as a turn
lane; and

WHEREAS, at the City Commission meeting held on January 12, 2000, the
City Commission approved resolution No. R-2000-19 authorizing the appropriate
City Officials to execute a Quit Claim Deed from the City of Tamarac to Broward
County granting additional right-of-way for a proposed turn lane on Commercial
Boulevard near the Senior & Community Center; and
WHEREAS, it was discovered by Broward County that the Quit Claim Deed
approved by the City Commission on January 12, 2000, reflected an incorrect legal
description due to errors made by the surveyor; and
WHEREAS, this resolution and attached Quit Claim Deed reflect the correct
legal description; and
WHEREAS, the Parks and Recreation Director recommends that the
appropriate City officials execute a Quit Claim Deed from the City of Tamarac to
Broward County granting additional right-of-way for the proposed turn lane on
Commercial Boulevard; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to
be in the best interest of the City of Tamarac to execute a Quit Claim Deed from the
City of Tamarac to Broward County granting additional right-of-way for the proposed
turn lane, attached hereto as "Exhibit 1 ".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA;

SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
Resolution.
SECTION 2: That the appropriate City officials are hereby authorized to
execute a Quit Claim Deed from the City of Tamarac granting additional right-of-way
to Broward County for a proposed turn lane on Commercial Boulevard near the
Senior and Community Center, a copy of said document being attached hereto as
"Exhibit 1 ".
SECTION 2: Resolution No. R-2000-19, attached hereto as "Exhibit 2", is
repealed in its entirety.
SECTION 4: That the City Clerk is hereby authorized and directed to record
said document in the public records of Broward County, Florida.
SECTION 5: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 6: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part
or application, it shall not affect the validity of the remaining portions or applications
of this Resolution.
SECTION 7: This Resolution shall become effective immediately upon
adoption.
