CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-97- I
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, APPROVING CHANGE ORDER NO. 1 AT
COST OF $38,952.45 TO THE CONTRACT WITH UNITED
UNDERGROUND CONTRACTOR CORPORATION ENTITLED
"TRACT 27 SPORTS COMPLEX SKATING ARENA/ ASSOCIATED
IMPROVEMENTS" FUNDED FROM THE PARKS AND
RECREATION IMPACT FEES FUND; APPROVING APPROPRIATE
TRANSFER OF FUNDS; AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO EXECUTE CHANGE ORDER NO. 1 BETWEEN
THE CITY OF TAMARAC AND UNITED UNDERGROUND
CONTRACTOR CORPORATION; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITYm AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Tamarac awarded Bid Number 96-01 on April 10, 1996 to United
Underground Contractor Corporation for the construction of a Skating Arena located in the Tract 27
Sports Complex in the amount of $236,488.73; and
WHEREAS, in the course of construction, additional work was required to address the
excavation and replacement of poor soils to prevent premature cracking and failing of the skating
surface as well as substituting concrete for asphalt under the bleachers and providing additional railing
and asphalt for safety purposes; and
WHEREAS, the City Engineer and the City's consulting engineer, Carr Smith, concur that the
additional work performed and represented in Change Order Number 1 was necessary and
appropriate; and
WHEREAS, the cost of the extra work when presented by the contractor in Change Order
Number 1 exceeded the bid price of the contract by $38,952.45; and
WHEREAS, by City Code Sec. 6-156, all change orders over $10,000 must be pre -approved
by the City Commission; and
WHEREAS, funds are available in the Parks and Recreation Impact Fees Fund to fully fund
Change Order Number 1; and

WHEREAS, it is the recommendation of the City Engineer that Change Order Number 1 be
funded, accepted, and executed; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best
interest of the citizens and residents of the City of Tamarac to approve the acceptance and execution
of Change Order Number 1 to the contract for the Tract 27 Skating Arena to United Underground
Contractor Corporation at a cost of $38,952.45 and to authorize the appropriate transfer of funds within
the Parks and Recreation Impact Fees Fund to fund this Change Order.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF TAMARAC,
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being
true and correct and are hereby made a specific part of this Resolution upon adoption hereof.
SECTION 2: Change Order No.1 to the contract for the Tract 27 Skating Arena is hereby
approved and the appropriate City officials are authorized to execute Change Order Number 1 between
the City of Tamarac and United Underground Contractor Corporation, a copy of which is attached
hereto as Exhibit 1".
SECTION 3: A budget transfer in the amount of $38,952.45 from Parks and Recreation Impact
Fees account entitled "Recreation Center/Concession Stand" to Parks and Recreation Impact Fees
account entitled "Skating Arena/Tract 27 Improvements" is hereby approved for correct accounting
purposes.
SECTION 4: The City Manager or designee is authorized to make changes, close the bid award
including but not limited to making final payment and releasing bonds when the work has been
successfully completed within the terms and conditions of the contract and within the bid price and
Change Order Number 1.
SECTION 5: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to
the extent of such conflict.

SECTION 6: If any provision of this Resolution or the application thereof to any person or
circumstance is held invalid, such invalidity shall not affect other provisions or applications of this
Resolution that can be given effect without the invalid provision or application, and to this end the
provisions of this Resolution are declared to be severable.
SECTION 7: This Resolution shall become effective immediately upon its passage and
adoption.
