RESOLUTION NO. R-97 143

A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO PURCHASE THREE (3)
SUBMERSIBLE PUMPS FROM ABS PUMPS, INC., A SOLE
SOURCE, AT A COST NOT TO EXCEED $26,066;
APPROVING FUNDING FROM THE APPROPRIATE UTILITY
OPERATING ACCOUNT; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the City Commission approved funding in FY 97 for the purchase of
three (3) submersible pumps to insure the uninterrupted operation of wastewater pumping
stations; and;
WHEREAS, the Utilities Department operates twenty-eight (28) pump stations which
utilize ABS pumps; and
WHEREAS, the purchase of these specialized pumps from ABS Pumps, Inc., will
enable the Utilities Department to operate the wastewater pumping stations without
shutdown while maintenance and repairs are performed; and
WHEREAS, ABS Pumps, Inc., complies with the Utilities Department Standard Bid
Specifications as approved products for wastewater pump stations; and
WHEREAS, the Utilities Department has received a quotation from ABS Pumps,
Inc., the sole source supplier of ABS submersible pumps for three (3) 23 horsepower
pumps at a cost of $26,066; and

WHEREAS, Section 6-151(3) allows for the exception to bid requirements for
equipment in excess of $10,000.00 when available from only one (1) source as per
attached as "Exhibit A"; and
WHEREAS, the Interim Director of Utilities recommends the purchase of three (3)
submersible pumps from ABS Pumps, Inc. at a cost of $26,066.00 be approved; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in
the best interest of the citizens and residents of Tamarac, Florida, to purchase three (3)
submersible pumps from ABS Pumps, Inc., in the amount of $26,066.00.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS' clauses are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this resolution.
SECTION2 That the appropriate City Officials are hereby authorized to purchase
three (3) 23 horsepower pumps at a cost not to exceed $26,066.00 from ABS Pumps, Inc.
SECTION 3: That funding is approved from the appropriate Utility Operating
Account.
SECTION 4: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 5: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 6: This Resolution shall become effective immediately upon its passage
and adoption.

Subject: ABS Pumps product source
Dear Sirs:
Pursuant to your inquiry regarding source availability of ABS equipment and parts in
Florida, please be advised that we are the factory direct branch office for the state of
Florida and are located approximately 35 miles northeast of Orlando in Orange City.
We are the sole source in Florida for ABS equipment, parts and service. A complete
inventory of pumps and replacement parts is maintained at our Orange City facility where
we provide full in-house factory service and field service with our fleet of three service
trucks. We also maintain a stock of rental and loaner pumps for emergency use in
addition to providing weekly pickup and delivery of pumps requiring factory service. All
service, including motor rewinds, is done in-house by factory trained personnel.
