CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-97-3
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING APPROPRIATE
CITY OFFICIALS TO ENTER INTO A SETTLEMENT
AGREEMENT WITH BERNADETTE CASTRO, BY
ACCEPTING TWENTY-TWO THOUSAND FIVE HUNDRED
DOLLARS ($22,500.00) AS FULL AND FINAL SETTLEMENT
FOR CODE ENFORCEMENT CASE 07590296JY,
CERTIFICATE OF OCCUPANCY FOR SHRINE OF ST. JUDE
CHURCH, LOCATED AT 7550 NORTH UNIVERSITY DRIVE,
TAMARAC, FLORIDA, AND CASE 07580296JY, SAFETY
INSPECTION FOR SHRINE OF ST JUDE CHURCH,
LOCATED AT 7550 NORTH UNIVERSITY DRIVE, TAMARAC
FLORIDA; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, on July 2, 1996, a claim of lien was filed in Code Enforcement Case
Number 07590296JY, certificate of occupancy for Shrine of St. Jude Church, located at
7550 North University Drive; and
WHEREAS, on July 2, 1996, a claim of lien was filed in Code Enforcement Case
Number 07580296JY, safety inspection for Shrine of St. Jude Church, located at 7550
North University Drive; and
WHEREAS, as of May 15, 1997, the fines owed on Case No. 07590296JY were
Sixty -Six Thousand Eight Hundred Dollars, ($66,800.00) plus Fifty Dollars ($50.00)
administrative costs; and
WHEREAS, as of May 15, 1997, the fines owed on Case No. 07580296JY were

Sixty -Six Thousand Eight Hundred Dollars, ($66,800.00) plus Fifty Dollars ($50.00)
administrative costs; and
WHEREAS, on May 15, 1997, the Tamarac Code Enforcement Board, in regular
meeting, voted unanimously not to abate the fees owed the City of Tamarac; and
WHEREAS, on June 4, 1997, Bernadette Castro filed a Notice of Administrative
Appeal in the Circuit Court of Broward County, appealing the May 15, 1997 Order of the
Tamarac Code Enforcement Board; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac that the appropriate
City officials accept a total amount of Twenty -Two Thousand Five Hundred Dollars
($22,500.00) from Bernadette Castro as full and final settlement of Case No. 07590296JY
and Case No. 07580296JY.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: That the foregoing "WHEREAS" clauses is are hereby ratified
and confirmed as being true and correct and are hereby made a specific part of this
Resolution.
SECTION 2: That the appropriate City officials are hereby authorized to
accept a total of Twenty -Two Thousand Five Hundred Dollars ($22,500.00) from

Bernadette Castro as full and final settlement of Code Enforcement Case No. 07590296JY,
certificate of occupancy for Shrine of St. Jude Church, located at 7550 North University
Drive, Tamarac, Florida, and Code Enforcement Case No. 07580296JY, safety inspection
for Shrine of St. Jude, located at 7550 North University Drive, Tamarac, Florida.
SECTION 3: That upon receipt of the Twenty -Two Thousand Five Hundred
Dollars ($22,500.00) from Bernadette Castro, the appropriate City officials are authorized
to execute and record a release of lien in Case No. 07590296JY and Case No.
07580296JY.
SECTION 4: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 6:

This Resolution shall become effective immediately upon its
