CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-97- /Sa
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA APPROVING THE CLOSING OF THE
CITY OF TAMARAC MUNICIPAL PARKING LOT BY
DECEMBER 31, 1997; AUTHORIZING APPROPRIATE CITY
OFFICIALS TO EFFECT THE CLOSING OF THE MUNICIPAL
PARKING LOT BY NOT RENEWING ANY EXISTING LEASES
AND TERMINATING ALL REMAINING LEASES AS OF
DECEMBER 31, 1997; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, the City of Tamarac Municipal Parking Lot is located at 5510 NW 22nd
Avenue, Tamarac, Florida; and
WHEREAS, the City maintained a fueling station on the property in the 1970s and
early 1980s; and
WHEREAS, due to leakage from a 2,000 gallon tank which was located at the site,
the site was declared contaminated; and
WHEREAS, the Department of Environmental Protection (DEP) mandated that the
City begin the process of identifying the extent of groundwater contamination, and
remediation if necessary; and
WHEREAS, the Municipal Parking Lot will be used to remove the groundwater
contamination when the project begins; and
WHEREAS, the parked vehicles at the Municipal Parking Lot site only add to the
contamination problems; and

WHEREAS, the City took the initial step towards the closing of the Municipal Parking
Lot in November 1994 when it decided that no new leases would be accepted; and
WHEREAS, the Director of Public Works recommends that in the light of public
safety and welfare, the Municipal Parking Lot be closed by December 31, 1997; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to close the City of
Tamarac Municipal Parking Lot by December 31, 1997.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: The closing of Municipal Parking Lot by December 31, 1997 is
HEREBY APPROVED.
SECTION 3: The appropriate City Officials are hereby authorized to effect the
closing of the Municipal Parking Lot by not renewing any existing leases and by terminating
all remaining leases as of December 31, 1997.
SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this Resolution is held
by any court of competent jurisdiction to be unconstitutional or invalid, in part or application,
it shall not affect the validity of the remaining portions or applications of this Resolution.

SECTION 6: This Resolution shall become effective immediately upon its passage
and adoption.
