R-97- gff A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING A MODEL SALES PERMIT FOR A SIX (6) MONTH PERIOD FOR THE SHANGRI-LA PROJECT LOCATED AT 8500 SOUTHGATE BOULEVARD; CASE NO. 1-MS- 97; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PRQVIplNG FOR AN EFFECTIVE DATE. WHEREAS, Article VI of Chapter 24 of the City Code provides for approval of temporary use model, sales and administrative facilities; and WHEREAS, the model sales permit for the Shangri-La project located at 8500 Southgate Boulevard have paid their fees; and WHEREAS, Shangri-La Enterprises, Inc. has requested the 300-foot distance separation for a model sales center be reduced to 0 feet due to the project being developed as attached townhomes; and WHEREAS, Shangri-La Enterprises, Inc. is requesting the waivers due to the potential hardship of not being able to occupy sold units; and WHEREAS, the Director of Community Development recommends approval of this model sales permit; and 11 1 L 1 August 27, 1997 - Temp. Reso. #7982 2 WHEREAS, the Planning Commission recommended approval of this model sales permit on September 3, 1997; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant this model sales permit. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission hereby approves the model sales permit for the Shangri-La project located at 8500 Southgate Boulevard for a six (6) month period from September 10, 1997 to March 10, 1998. SECTION I That the distance separation from 300 feet to 0 feet from units with certificates of occupancy (due to the project being developed as attached townhomes) is hereby approved. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. 1 1 C� August 27, 1997 - Temp. Reso. #7982 3 SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
