R-97 c?'3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ESTABLISHING FISCAL YEAR 1998 USER FEES FOR THE CITY OF TAMARAC OFFICE OF SOCIAL SERVICES TRANSPORTATION PROGRAM; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, The City of Tamarac, Florida, recognizes the need for residents to have access to transportation to medical appointments and grocery shopping and authorizes that this transportation be provided by the City of Tamarac Office of Social Services; and WHEREAS, the transportation program is a specialized service benefiting the individuals who utilize the service and the individuals should pay a portion of the cost of the service; and WHEREAS, the City Code authorizes fees to be set for Social Service Department programs; and WHEREAS, user fees for the Social Services transportation program will be set as follows: $.50 one way and $1.00 round trip or annual pass for $5.00; and WHEREAS, the Parks and Recreation Director and the Finance Director recommend approval; and WHEREAS, the City Commission deems it to be in the best interest of the citizens and residents to implement a user fees for the City of Tamarac Office of Social Services transportation program effective for Fiscal Year 1998; and xr•Cin 1 Page 2 Temp. Reso. # 8026 Rev. #1 - 10/14/97 Rev. #2 - 11 /20/97 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA; Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. Section 2: That the fee for the transportation program shall be $.50 one way and $1.00 round trip or annual pass for $5.00; and Section 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
