R-97 0 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO ACCEPT AND AWARD BID NUMBER 96-21 TO THE LOWEST RESPONSIVE AND RESPONSIBLE BIDDER, DIONEX, CORPORATION FOR THE PURCHASE OF AN ION CHROMATOGRAPH AT A COST OF $14,961.00; PROVIDING FOR FUNDING FROM THE APPROPRIATE UTILITIES OPERATIONAL ACCOUNT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac is required by the Broward County Department of Health and the Department of Natural Resource Protection to test for inorganic contaminants in the finished and ground water; and WHEREAS, an Ion Chromatograph will test for these contaminants more efficiently than current methods; and WHEREAS, Bid 96-21, Ion Chromatograph, was advertised on October 29, 1996 and November 5, 1996; and WHEREAS, on November 8, 1996, the following bids were opened: 1) Dionex Corporation $14,961.00 2) Lachat Inc. No Bid WHEREAS, the ion chromatograph must be compatible with existing operational software; and Temp. Reso. #7627, December 3, 1996 2 WHEREAS, Dionex Corporation was the lowest responsive and responsible bidder for the purchase of an Ian Chromatograph at $14,961.00; and WHEREAS, funds in the amount of $15,000 were budgeted in FY97 to fully fund this purchase; and WHEREAS, it is the recommendation of the Director of Utilities and the Purchasing - Contracts Manager that Bid Number 96-21 be awarded to Dionex Corporation; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve the award of Bid Number 96-21 to Dionex Corporation, as the lowest responsive and responsible bidder for the purchase of an Ion Chromatograph; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. SECTION 2: That pursuant to Section 6-149 of the City of Tamarac Code, the purchase of an Ion Chromatograph by the Purchasing -Contracts Manager from Dionex Corporation utilizing Bid 96-21 at a cost of $14,961.00, as funded in FY97 under the appropriate Utilities Operational Account is hereby approved. All resolutions or parts of resolutions in conflict herewith are L 1 Temp. Reso. #7627, December 3, 1996 3 hereby repealed to the extent of such conflict. SECTION 4: If any clause, section other part or application of this Resolution is held by any Court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
