R-97- 46 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO PURCHASE A BOBCAT LOADER, MODEL #733, FROM MELROE INGERSOLL RAND, UTILIZING GENERAL SERVICES ADMINISTRATION CONTRACT #GS-30E-1051 D, AT A COST NOT TO EXCEED $35,000; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DAIL WHEREAS, Melroe Ingersoll Rand is an authorized Bobcat dealer and has a General Services Administration Contract; and WHEREAS, City of Tamarac Code, Section 6-155, allows the Purchasing Officer the authority to waive purchasing procedures for all supplies, material and equipment, which are the subject of contracts with the United States Government or with other governmental agencies; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interests of the citizens and residents of the City of Tamarac to approve the purchase of a Bobcat Loader, Model #733, from Melroe Ingersoll Rand Company. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: 1 Page 2 Temp. Reso. #7638 December 19, 1996 Revision #1 01/08/97 SECTION _1: That the foregoing "WHEREAS" clauses are HEREBY RATIFIED and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: Authorizing the purchase of a Bobcat Loader, Model #733, at a cost not to exceed $35,000 from Melroe Ingersoll Rand Company utilizing a General Services Administration Contract #GS-30E-1 01 5D, a copy of GSA Approved Purchasing Schedule being hereto attached as Exhibit "1 ". -SECTION , L All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTIONA. If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
