R-97 63 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO ACCEPT AND AWARD BID NO. 97-11 B TO THE LOWEST RESPONSIVE AND RESPONSIBLE BIDDERS, KELLY TRACTOR AND SUN COAST TRAILER, FOR THE PURCHASE OF A HYDROSTATIC VIBRATORY ROLLER AND OPEN TRAILER AT A COST OF $10,500.00 AND $1,985.00, RESPECTIVELY; PROVIDING FOR FUNDING FROM THE APPROPRIATE PUBLIC WORKS ACCOUNT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE, WHEREAS, Bid No. 97-11 B for a Hydrostatic Vibratory Roller and Open Trailer was advertised in the Sun Sentinel on January 19th, and 26th, 1997; and WHEREAS, on February 6th, 1997, the following Bids were opened: NO. Reso. # 7789 Page 2 February 21, 1997 Rev. #1 - 2/27/97 Rev. #2 - 3/17/97 WHEREAS, funds were budgeted in FY '97 to fully fund these purchases; and WHEREAS, it is the recommendation of the Public Works Director, City Engineer and the Purchasing -Contract Manager that Bid No. 97-11 B be awarded to Kelly Tractor and Sun Coast Trailer; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve the award of Bid No. 97-11 B to Kelly Tractor and Sun Coast Trailer, as the lowest responsive and responsible bidders for the purchase of a Hydrostatic Vibratory Roller and an Open Trailer, respectively. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are HEREBY RATIFIED and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. SECTION 2: That pursuant to Section 6-149 of the Tamarac City Code, the purchase of the Hydrostatic Vibratory Roller for $10,500.00, and an Open Trailer for $1,985.00, by the Purchasing -Contracts Manager from Kelly Tractor and Sun Coast Trailer, respectively, as funded in FY'97 in the appropriate Public Works account is HEREBY APPROVED. (A copy of Bid No. 97-11 B is attached hereto as Exhibit 1.) SEQBON 3: All Resolutions or parts of Resolutions in conflict herewith are HEREBY REPEALED to the extent of such conflict. S�TION 4: If any Clause, Section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it Temp.
