RESOLUTION NO. R-9770
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, APPROVING THE RENEWAL OF
BROWARD COUNTY CO-OP CONTRACT #D-11-94-09-12
"DIESEL FUEL," AUTHORIZING THE PURCHASE OF
DIESEL FUEL IN THE AMOUNT OF $21,000 FUNDED FROM
THE FLEET SERVICES FUND AND UTILITIES WEST
OPERATING FUND; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, diesel fuel is necessary in order to operate City vehicles; and
WHEREAS, Broward County has renewed Co-op Bid #D-11-94-09-12 awarded to
Port Petroleum Inc., for quantities under 7,500 gallons per delivery for a one-year period.
Bid renewal is for the period starting February 1, 1997 and terminates on January 31,
1998; and
WHEREAS, City of Tamarac Code, §6-155, allows the Purchasing/Contracts
Manager the authority to join with other units of government in cooperative purchasing
when the best interest of the City would be served; and
WHEREAS, it is the recommendation of the Director of Public Works and the
Purchasing/Contracts Manager that Broward County Co-op Bid #D-11-94-09-12 be
renewed; and

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to purchase diesel fuel
from Port Petroleum Inc.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution
upon adoption hereof.
SECTION 2: That the appropriate City Officials are hereby authorized to
purchase diesel fuel from Port Petroleum Inc. under Broward County Co-op Contract #D-
11-94-09-12, a copy of said renewal notice being hereto attached as Exhibit "A."
E TI N : That the purchase of diesel and gasoline fuels are hereby
authorized in the amount of $18,000 from the Fleet Services Fund and in the amount of
$3,000 from the Utilities West Operating Fund.
SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 5: If any provision of this Resolution or the application thereof to
any person or circumstance is held invalid, such invalidity shall not affect other provisions
or applications of this Resolution that can be given effect without the invalid provision or
application, and to this end the provisions of this Resolution are declared to be severable.

during the renewal period indicated above. This renewal is contingent on vendor acceptance which may include price
increase pursuant to the terms, and conditions of the contract.
This contract has a provision for pricing in which prices shall remain firm for one- week intervals and is based on the
OPIS published price dated the preceding Thursday plus a furn mark-up or discount inclusive of all costs including
delivery costs.
If you choose not to utilize this contract for the renewal period, indicate the reasons) below.
