R-97--Ze2 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING THE CAR ALLOWANCE FOR THE CITY ATTORNEY; APPROVING A GENERAL FUND BUDGET TRANSFER; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Attorney is a charter officer of the City of Tamarac and works directly for the City Commission; and WHEREAS, the City Attorney's car allowance has not been adjusted since June, 1994; and WHEREAS, the City Commission has determined that a Seven Hundred Dollar ($700.00) per month car allowance is a fair and equitable car allowance for charter officers of the City of Tamarac; and WHEREAS, available funds exist in the General Fund budget for said purpose; and WHEREAS, the City Commission of the City of Tamarac believes an adjustment in the car allowance of the City Attorney is fair and equitable. Temp. Reso. # 7819 2 3/27/97 Rev. #1: 3/31/97 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The City Attorney's car allowance, effective October 1, 1996, shall be Seven Hundred Dollars ($700.00) per month. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: A budget transfer in the amount of Three Thousand Dollars ($3,000.00) from General Fund account entitled "Legal Services" to General Fund account entitled "Automobile Allowance" is hereby approved for correct accounting purposes. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
