R-97- 75 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA; TO APPROVE A MINOR DELEGATION REQUEST TO INCREASE THE COMMERCIAL BUILDING SQUARE FOOTAGE FOR PARCEL "B" BY 3,636 SQUARE FEET FOR A TOTAL OF 28,740 SQUARE FEET, AND CHANGE THE NOTE ON PARCEL "A" TO ALLOW SIXTY-TWO (62) MULTI -FAMILY RESIDENTIAL UNITS IN LIEU OF THE PREVIOUSLY APPROVED 74,896 SQUARE FEET OF COMMERCIAL USE ON A REPLAT OF A PORTION OF "FLORIDA FRUIT LANDS COMPANY'S SUBDIVISION NO. 2", ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 1, PAGE 102 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA; LOCATED AT THE NORTHEAST CORNER OF NOB HILL ROAD AND WESTWOOD DRIVE; CASE NO. 6-P-97; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission has examined the application and staff recommendation dated April 9, 1997; and WHEREAS, the City Commission has determined that the application is in compliance with all elements of the Comprehensive Plan for the development that is the subject of the application; and WHEREAS, at the time the plat was recorded, Broward County did not have the benefit of a conceptual site plan for the proper determination of entrance openings; and WHEREAS, the property owner desires to increase the commercial building square footage for Parcel "B" by 3,636 square feet for a total of 28,740 square feet, and change the note on Parcel "A" to allow sixty-two (62) multi -family residential units in lieu of the previously 1 1 11 March 19, 1997 - Temp. Reso. #7809 2 approved 74,896 square feet of commercial use on a Replat of a portion of "Florida Fruit Lands Company's Subdivision No. 2", according to the Plat thereof, as recorded in Plat Book 1, Page 102 of the Public Records of Broward County, Florida; located at the northeast corner of Nob Hill Road and Westwood Drive; Case No. 6-P-97; and WHEREAS, the Director of Community Development recommends approval; and WHEREAS, the Planning Commission recommended approval on March 19, 1997; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to approve this delegation request; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION L. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission hereby approves the Minor Delegation Request to increase the square footage for Parcel "B" by 3,636 square feet for a total of 28,740 square feet, and change the note on Parcel "A" to allow sixty-two (62) multi -family residential units in lieu of the previously approved 74,896 square feet of commercial use on a Replat of a Portion of "Florida Fruit Lands Company's Subdivision No. 2", according to the Plat thereof, as recorded in Plat Book 1, Page 102 of the Public Records of Broward County, Florida; located at the northeast corner of Nob Hill Road and Westwood Drive; Case No. 6-P-97; March 19, 1997 - Temp. Reso. #7809 3 SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
