R-97-_D A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING THE HEALTH CARE AGENCY AFFILIATION AGREEMENT WITH BROWARD COMMUNITY COLLEGE FOR FIELD INTERNSHIP BY ALLOWING PARAMEDIC STUDENTS TO RIDE ALONG ON THE CITY'S RESCUE UNITS; AUTHORIZING EXECUTION OF THE HEALTH CARE AGENCY AFFILIATION AGREEMENT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac through the Fire Department provides advanced life support (ALS) transport; and WHEREAS, Broward Community College has requested that the City of Tamarac allow paramedic students to ride along on the City's fire rescue units in order to gain the experience needed to become a State Certified Paramedic; and WHEREAS, Broward Community College has provided the City of Tamarac with an Affiliation Agreement attached hereto as Exhibit "A"; and WHEREAS, the Agreement also enables the City to have our own personnel attending Paramedic school to ride on our rescue units; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to approve the 1 1 1 Temp. Reso. # 7801 2 March 11, 1997 March 17, 1997 Affiliation Agreement with Broward Community College to allow paramedic students to ride on Tamarac rescue units. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTIQU 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and is hereby made a specific part of this Resolution. SECTION 2: That the Commission approve the Affiliation Agreement between the City of Tamarac and Broward Community College to allow paramedic students to ride on City fire rescue units and authorizing the appropriate City Officials to execute the Health Care Agency Affiliation Agreement (attached hereto as Exhibit "A"). SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its passage and adoption. d E Temp. EVANS CITY CLERK I HEREBY CERTIFY that I have approved this RE80LUTION as to forrna 11 F ELLS' KfiA CITY ATTORNEY (c:\wpdata\res\.jt) Joe Schreiber MAYOR RECORD OF COMMISSION MST 1:.CaA9-hz FIST 2: v DIST 3:� DIET 4:CS tt117 r� L r� EXHIBIT A TEMP RESO #7801 PAGE 1 HEALTH CARE AGENCY AFFILIATION AGREEMENT Agreement entered into this 30 day of April , 19 97 by and between the DISTRICT BOARD OF TRUSTEES OF BROWARD COMMUNITY COLLEGE, hereinafter referred to as the COLLEGE, and CITY OF TAMARAC inafter referred to as the HEALTH CARE WITNESSETH: WHEREAS, the COLLEGE desires that students enrolled in its health related programs as affiliated with the HEALTH CARE AGENCY obtain clinical experience at the HEALTH CARE AGENCY; and WHEREAS, the HEALTH CARE AGENCY is offering to provide the necessary facilities for said clinical experience in recognition of the need to educate health -related personnel. NOW, THEREFORE, for and in consideration of the promises and the mutual covenants and agreements herein contained, the parties hereto agree as follows: 1. The education of the student shall be the only purpose of the program. 2. Both parties agree not to discriminate against any student, in any manner whatsoever on account of race, creed, color, sex, age, national origin, or mental or physical handicap, provided that such handicap does not prevent satisfactory performance. 3. The HEALTH CARE AGENCY agrees to accept COLLEGE students as determined by mutual consultation and to make available as practical facilities to the COLLEGE in order to provide necessary clinical experiences. The COLLEGE shall be responsible for the classroom instruction curriculum, maintenance of permanent records, and education experiences and evaluation of programs through an employed instructor. 4. The HEALTH CARE AGENCY agrees to make available Emergency Room treatment, when such facilities exist, for minor injuries incurred by students while in the HEALTH CARE AGENCY for clinical experience, and without cost to the student. Treatment for minor injuries will be rendered by the Emergency Room Physician on duty. The HEALTH CARE AGENCY is not responsible for charges made to the student by a private physician rendered to the student in said HEALTH CARE AGENCY. 0% 5. The COLLEGE shall select practical educational experiences based upon the needs �.,�, of the students to meet objectives of the program. EXHIBIT A TEMP RESO #7801 PAGE 2 6. The COLLEGE shall, at its discretion, appoint a Program Director and clinical instructors as required for a given program. The HEALTH CARE AGENCY shall assure college personnel access to the appropriate clinical areas to perform instruction and evaluation of the program and students. 7. At the discretion of the HEALTH CARE AGENCY or the COLLEGE, any student unacceptable for the reasons of health, performance, or any other reasonable and legally permissible cause shall be withdrawn from the HEALTH CARE AGENCY. 8. All services rendered by students under this Agreement for the HEALTH CARE AGENCY, employees, and patients shall be uncompensated and shall be deemed to be given in consideration for instruction and educational experience. Student participants shall not be considered to be employees of the HEALTH CARE AGENCY. At all times the HEALTH CARE AGENCY will maintain full responsibility for patients being cared for by students in the COLLEGE Program. 9. The College shall and does hereby agree to defend, indemnify, and hold harmless the HEALTH CARE AGENCY, its directors, officers, stock -holders, and employees from and against any and all claims, demands, liabilities, damages, and expenses for injury to persons or damage to property to have been caused directly or indirectly by the negligent acts of, or as a result of the performance of duties by College, its officers, directors, agents, servants, or employees under this Agreement to the extend permitted by the Florida Constitution and Florida Statute 768.28 or any amendments thereto. Any and all such indemnification shall be limited to and shall not exceed the amount of insurance coverage applicable to such an indemnification agreement provided to the College through the Florida Community College Risk Management Consortium. The COLLEGE will require students to secure professional liability insurance coverage in the minimum amount of $1,000,000/$3,000,000 per year. The COLLEGE shall provide the hospital with certificate of insurance evidencing that this coverage has been obtained. 10. The HEALTH CARE AGENCY, when requested and mutually agreed upon, will assist in the responsibility for the direct guidance and supervision of the students while on the premises of the HEALTH CARE AGENCY and will cooperate in evaluating student performance. The qualification of the HEALTH CARE AGENCY staff participating in the supervision of the students shall be subject to review and approval by the COLLEGE. 11. The COLLEGE Program Director shall recommend appointment of affiliate faculty. The COLLEGE Program Director shall advise faculty regarding course content, objectives, student evaluation criteria and procedures. Affiliate faculty are responsible to the Program Director for the supervision of students in the program. Continuation and renewal of affiliate faculty status is contingent upon satisfactory performance and the COLLEGE'S need for the position in the HEALTH CARE AGENCY. r • EXHIBIT A TEMP RESO #7801 PAGE 3 12. The term of this Agreement shall be for the period April 30, 1997 through June 30, 1997 and from year to year thereafter except that either party may terminate this Agreement by giving sixty (60) days written notice (registered mail to the party).
