MALACHY CATHOLIC CHURCH b PROJECT FOR A REVISED SITE PLAN PURSUANT TO THE PROVISIONS OF SECTIONS 10-2 THROUGH 10-29 6 OF THE TAMARAC CODE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City l Council of Tamarac, Florida, a public meeting has been advertised 9 ivin accordance with applicable law of the date, time and place of the meeting regarding the review of the application for a revised 11 32 development order by the applicant foZ development approval; and WHEREAS, the City Council has examined and investigated 13 14 the application, staff and Planning Commission recommendations, and 35 the attached Development Review Status Sheet dated January 18, 16 1991; and 17 WHEREAS, the City Council reviewed the revised develop- 16 ment order and accompanying documents at a public meeting; and 1 WHEREAS, the City Council has determined that the appli- 2CI cation is in compliance with all elements of the Comprehensive 21 Plan, or will be in compliance prior to the issuance of a 22 Certificate of Occupancy for the development that is the subject of 23 the application. 24 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 25 TAMARAC, FLORIDA: 26 SECTION 1: That the application for approval of a 27 revised site plan for St. Malachy gatholic Church, prepared by 28 Arpin and Son Engineering, Inc., revised on September 1, 1990, 29 reflecting the addition of 1,800 square feet of floor area for a 3G vestibule and two confessionals is HEREBY APPROVED subject to the 31 following conditions: 3.1 A. The revised development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the revised development order are set forth as follows: 1. The landscape buffer be minimum of twelve (12) feet wide and three (3) feet in height. 2. The parking in the front of the building has an additional landscape island. 3. All dumpsters must be enclosed and screened. 4. Approval will be subject and take effect at the time the traffic impact fees are paid and the restrictive covenant is delivered to the City in recordable form. SECTION 2: Should any section or provision of this revised development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. The site is located in a compact deferral area due to overloaded traffic capacities on nearby county roads. The applicant has agreed to add a restrictive covenant on the property so as not to allow the addition to increase the traffic on the county roads. This covenant will restrict the use to a vestibule and two confessionals and will not be used to increase the capacity of • the Church. The above proposed solution is unique to this site and is not to be used as an example to mitigate concurrency. 2. At the Site Plan Review Committee meeting on January 15th the committee recommended approval of the revised site plan with the following conditions: a. The landscape buffer be a minimum of twelve feet wide and three feet in height. b. The parking in the front of the building have an additional landscape island. c. All dumpsters must be enclosed and screened. 3. All requirements from the Fire, Engineering, and Building Departments have already been agreed to. 4. The city traffic impact fee for this project is $290.00. Recommendation Staff recommends approval of the revised site plan subject to the above conditions. Cl
