CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-91-- 1---�-,7
A RESOLUTION ACCEPTING A RESTRICTIVE
COVENANT RESTRICTING THE USE OF THE
FIFTEEN (15) MULTIPLE BAY GARAGES AT
SPRING HOUSE APARTMENTS TO VEHICLE PARK-
ING ONLY; AND PROVIDING AN EFFECTIVE
DATE.
BE IT RESOLVED BY THE COUNCIL, OF THE CITY OF TAMARAC, FLORIDA;
SECTION 1: That the Restrictive Covenant restricting the
use of the fifteen (15) multiple bay garages at Spring House
Apartments at the northeast corner of Commercial Boulevard and
Rock Island Road, is hereby accepted, a copy of said covenant
being attached hereto as "Exhibit 1".
SECTION 2: The Restrictive Covenant will become effective
at the time when a building permit is issued in connection with
the construction of the garages, at which time the City Clerk
is hereby authorized and directed to record said Covenant in
the public records of Broward County, Florida.
SECTION 3: This Resolution shall become effective
immediately upon adoption.

EXHIBIT 1
RESTRICTIVE COVENANT
Whereas Lakeview-Nort, Ltd., Treehouse Associates, Ltd., and
Rock Island Associates, Ltd., as tenants in common is the
owner (hereinafter referred to as "owner") of real property
known and described as:
Springhouse, An Oxford Community, Tract A, Plat Book
128, Page 50 of the Public Records of Broward County,
Florida (hereinafter referred to as "Property")
Whereas owner, in consideration for obtaining the City of
Tamarac's approval for the construction of garages on the
Property, is willing to make the covenants contained herein.
Now, therefore,
Owner voluntarily and without duress of any kind or
• nature, does hereby agree as follows:
1. The garages can only be used for vehicle parking.
2. The garages can only be used by residents of the
Property.
3. A sufficient number of the garages will be used so
that the garage parking when combined with the non -
garage parking at the Property will meet the
minimum parking requirements of the City of Tamarac
for this Property of 1.5 spaces for each one
bedroom unit and 1.75 spaces for each 2 bedroom
unit, plus 10% additional parking for guests (based
on the number of units at the Property).
4. That in the event of a violation of the aforestated
coven -ant, the City of Tamarac will have as its sole
and exclusive remedies the remedies contained in
the Tamarac Code for a violation of the Tamarac
Code, as well as the right to obtain injunctive
relief.
5. This restrictive covenant shall be recorded amongst
the Public Records of Broward County, Florida.
6. This restrictive covenant will only be effective if
garages are, in fact, constructed on the Property.
7. This restrictive covenant shall run with the
property and be binding upon the owners successors
and assigns from this date and forever.
