CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-91-J2]5
A RESOLUTION AUTHORIZING ST. MALACHY
CHURCH TO CONDUCT A CARNIVAL/CIRCUS
ON THURSDAY, NOVEMBER 7, THROUGH,
MONDAY, NOVEMBER 11, 1991; CONTINGENT
UPON APPROVAL AND THE EXECUTION OF A
HOLD HARMLESS AGREEMENT; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, Saint Malachy Parish wishes to promote a
carnival/circus to benefit the Saint Malachy Parish and other
worthy causes; and
WHEREAS, Saint Malachy Parish has requested authoriza-
tion to conduct a carnival/circus on Thursday, November 7,
through, Monday, November 11, 1991 on a portion of church
property, located on University Drive, North of 61 Street.
Whereas, Saint Malachy Parish has submitted a Hold
Harmless Agreement to the City for this event and has agreed
to hold- the City harmless of any claims whatsoever arising
from the location, sale and operation of the carnival/circus
function.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1 That the granting of the approval for the
carnival/circus is subject to an executed Hold Harmless
Agreement between the City, Saint Malachy Parish and Funtas-
tic d/b/a Leisure Time Associates; and
SECTION 2 That the City Council hereby grants
authorization for Saint Malachy Parish to conduct a carnival -
circus on Thursday, November 7, through, Monday, November 11,
1991 on church property, located on University Drive, North
of 61 Street.

SECTION 3 : This Resolution shall become effective
immediately upon adoption.

HOLD HARMLESS AGREEMENT
This agreement entered into on the � day of a2�r�
. 1991, is made by and between the City of Tamarac, a municipal
corporation, hereinafter, "CITY", the St. Malachy Church,
.hereinafter, ST. MALACHY, and Funtastic d/b/a Leisure Time
Associates, hereinafter, FUNTASTIC.
W I T N E S S E T H:
WHEREAS, ST. MALACHY, wishes to sponsor a Carnival and
Circus on Thursday, November 7 through Monday, November 11,
1991 to benefit St. Malachy Church and other worthy causes;
and
. WHEREAS, ST. MALACHY wishes to stage the Carnival and
Circus on a portion of church property located on University
Drive, North of 61 Street, on Thursday, November 7 through
Monday, November 11, 1991; and
WHEREAS, the City Council of the City of Tamarac has
determined that the execution of this Hold Harmless Agreement
is in the public interest.
NOW, THEREFORE, in consideration of the sum of one
dollar ($1.00) and other good and valuable consideration
received from ST. MALACHY and in consideration of the mutual
convenants contained herein, the parties agree as follows:
SECTION 1 : That ST. MALACHY and FUNTASTIC, shall
indemnify, hold the CITY harmless and defend the CITY from
any and all claims, causes of action, damages, costs,
expenses and attorney fees which the CITY shall suffer by
virture of the defense of, or response to, any claim being
made against it in connection with the Carnival and Circus
sponsored by ST. MALACHY and FUNTASTIC, their agents,
employees, members, participating businesses, or the general
public in connection therewith.
SECTION 2 The above provisions shall survive
the

termination of this Agreement and shall pertain to any
occurrence during the term of this Agreement, even though the
claim may be made after the termination hereof.
SECTION 3 : ST. MALACHY shall provide the City Risk
Manager all necessary Certificates of Insurance in such form
and amounts as required by the Risk Manager.
SECTION 4 ST. MALACHY shall keep such policies of
insurance in full force and effect during the term of this
Agreement and shall provide to the City Risk Manager proof of
payment of the required documents.
SECTION 5 : ST. MALACHY shall provide the CITY with
the requisite document evidencing that the signatory for the
ST. MALACHY has the authority to enter into this Agreement.
SECTION 5 This Agreement shall not be assigned
without receiving City Council approval.
