A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA, OPPOSING A USER FEE ON ELECTRONIC TRANSFERS OF FUNDS AS PROPOSED TO BE IMPOSED ON ALL LARGE DOLLAR PAYMENT FUNDS IN THE UNITED STATES; PROVIDING THAT COPIES OF THIS RESOLUTION BE FORWARDED TO SENATOR JOHN KERRY AND THE FLORIDA SENATORS AND CONGRESSMEN; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE WHEREAS, it has come to the attention of the City Council of the City of Tamarac, Florida, that United States Senator John Kerry has proposed that a user fee be imposed on all large electronic payment of funds in the United States in order to fund a portion of the increased federal debt incurred as a result of the Savings and Loan bail out; and WHEREAS, the above -mentioned proposed legislation would make the Secretary of the Treasury authorized to establish the amount of the fee and implement its collection; and WHEREAS, the suggested fee is .002 per dollar value of transfer and the city currently uses electronic transfers of large sums of monies that are normally wired to the State Board of Administration for investment purposes; and WHEREAS, the suggested fee based on the city's current wire transfer would be a minimum cost of $43,000 per year; and WHEREAS, the City Council of the City of Tamarac, Florida, hereby declares its opposition to the proposed legislation and directs that copies of this resolution be forwarded to Senator John Kerry and the Florida Senators and Congressmen; r as 29 20 32 ]. ]5 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY TAMARAC, FLORIDA, THAT: The foregoing "WHEREAS" clauses are true an correct and are hereby ratified and confirmed by the City Council. The City Council of the City of Tamarac, Florida, hereby declares its opposition to Senator John Kerry's propose legislation to introduce a user fee to be imposed on all large dollar electronic payment of funds which would result in an estimated minimum annual cost to the city of $43,000. SECTION __3: The city clerk is hereby directed to forward copies of this Resolution to Senator John Kerry and the Florida Senators and Congressmen. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
