R-91-.C,9aO A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER FOR WOODMONT GARDENS PROJECT FOR A FINAL SITE PLAN PURSUANT TO THE PROVISIONS OF SECTIONS 10-2 THROUGH 10- 29 OF THE TAMARAC CODE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regarding the review of the application for a revised development order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application, Staff and Planning Commission recommenda tions; and WHEREAS, the City Council reviewed the revised develop- ment order dated December 19, 1990 and accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the appli- cation is in compliance with all elements of the Comprehensive Plan,- or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the application for a one (1) year extension for Phase 1 and for a four (4) year extension for Phase 2 site plan for Woodmont Gardens is -approved subject to the following conditions: A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status Sheet and approved engineering drawings. Temp. Reso. # 6191 B. Commencement of construction shall be no longer than one year from December 19, 1991 for Phase 1 and four (4) years from December 19, 1991 for Phase 2. If the development does not commence construction within this time period, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. The revised development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the revised development order are set forth as follows: That if, in the future, there were more stringent requirements for approval of a site plan that Woodmont Gardens ACLF would modify their site plan to accommodate those new regulations. SECTION 2: Should any section or provision of this revised development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. SECTION 4: This revised development order as condi- tioned shall become effective immediately -upon its passage. PASSED, ADOPTED AND APPROVED this 11thday of 1991.
