CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R--91--
A RESOLUTION TRANSFERRING AND AMENDING A
SPECIAL USE EXCEPTION TO ALLOW COOKING ON -
PREMISES FOR HOME DELIVERY AND CARRY --OUT
BAGELS TO 7110 NORTH UNIVERSITY DRIVE IN THE
FAMILY MART SHOPPING CENTER, PETITION 25-Z-
91; REQUESTED BY BAGEL CITY, PROVIDING FOR
CONDITIONS OF THE SPECIAL EXCEPTION USE;
PROVIDING -AN -EFFECTIVE DATE.
WHEREAS, on. May 24, 1989, the City Council adopted
Resolution No. R-89-140, granting Pizza Hut of Titusville,
Inc. a special exception to permit cooking on -premises for
home delivery and carry --out pizza at 7110 North University
Drive in the Family Mart Shopping Center; and
WHEREAS, the City Council wishes to transfer said Special
Use Exception to 7110 North University Drive in the Family
Mart Shopping Center as requested by Bagel City, the new
owner; and
WHEREAS, the City Council also wishes to amend said
Special Use Exception to allow cooking on -premises for carry-
out bagels to the location of 7110 North University Drive in
the Family Mart Shopping Center.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION-1: That the Special Use Exception granted on
May 24, 3.989 by Resolution No. R--89--140 to Pizza Hut of
Titusville, Inc., located at 7110 North University Drive,
Tamarac, is HEREBY TRANSFERRED to the location of 7110 North
University Drive in the Family Mart Shopping Center, Petition
#25-Z--91, as requested by Bagel City.
SECTION 2: That the Special Use Exception is HEREBY
AMENDED to permitting cooking on -premises for carryout bagels
at 7110 North University Drive in the Family Mart Shopping
Center as requested by Bagel City.

SECTION 3: The following conditions will apply:
A. The applicant shall be
required
to pay
all
appropriate administrative
fees and
submit
the
required documents associated with the Special Use
Exception Transfer.
B. The Special Exception is transferable, adminis-
tratively, by City Staff, pursuant to compliance
with City Codes and submitting documentation.
SECTION 4 This Resolution shall become effective
immediately upon its adoption.
