R--89- r A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER NO. 216-1 FOR DEVON PROJECT FOR A FINAL SITE PLAN AND RELATED DOCUMENTS PURSUANT TO THE PROVISIONS OF SECTIONS 7-2 THROUGH 7-11 OF THE TAMARAC CODE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of Tamarac, Florida., a public meeting has been adver- tised in accordance with applicable law of the date, time and place of the meeting regarding the review of the application for a revised development order by the applicant for develop- ment approval; and WHEREAS, the City Council has examined and investigated the application, staff and Planning Commission recommenda- tions and the attached Development Review Status Sheet dated January 6, 1989; and WHEREAS, the City Council reviewed the revised develop- ment order and accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the appli- cation is in compliance with all elements of the Comprehen- sive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 That the development described on the attached Development Review Status Sheet dated January 6, 1989 is granted a revised development order to proceed subject to the following conditions: A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in Section IT of the Devel- opment Review Status Sheet and approved engineering drawings. 1 2 Temp. Reso. #5287 *Rev. 1/11/89 3 B. Commencement of construction shall be no longer than 4 one year from the date of this approval. If the development 5 does not commence construction within one year, this approval 6 is null and void unless an extension has been granted in accordance with applicable regulations. C. The revised development order is assignable, but an assignment does not discharge any assignee from strict com- 10 pliance with the order unless the City Council consents to 11 modify any of the original requirements. 12 D. Additional conditions established in order to issue 13 the revised development order are set forth as follows: 14 Approval is contingent upon Opinion of Title being presented to the City showing ownership of pro-- 15 perty is vested in Lennar Homes. 16 SECTION 2 That the following documents are hereby 17 accepted and approved as a part of this revised development 18 order: 1 1. Water and Sewer Development Agreement (Phase I) 2. Water and Sewer Utility Easement 1 3. Blanket Public Safety Ingress/Egress Easement 4. Declaration (per Stipulation 9 & 12) 5. Irrevocable option (for private roads in Devon project) 22 23 SECTION 3 : Should any section or provision of this 24 revised development order be declared by a court of competent 25 jurisdiction to be invalid, the City Council shall determine 26 if the other portions of the order remain valid or whether 27 the approval shall be null and void. 28 SECTION 4 : This revised development order as condi- 29 tioned shall become effective immediately upon its passage. 30 PASSED, ADOPTED AND APPROVED this �L d9L±� of 31 1989.
