CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-89-Y
A RESOLUTION GRANTING A LIMITED WAIVER OF PARKING
REQUESTED BY FIRST REALTY MANAGEMENT GROUP, INC.,
AT SWANSON WEST PLAZA, PETITION NO. 5-Z--89; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Chapter 18 of the Tamarac City Code provides
that the City Council may grant a limited waiver of the off-
street parking an loading requirements whenever a hardship
would exist by adhering to strict application thereof, and
further provides that the waiver would not be detrimental to
public safety, health and welfare of the citizens of the
City; and
WHEREAS, a hardship exists at Swanson West Plaza; and
WHEREAS, the Planning Commission has held a public
hearing thereon and has recommended denial of this
application; and
WHEREAS, the City Council desires to take action on the
limited waiver requested in the application of First Realty
Management Group, Inc., for Swanson West Plaza, Petition
#5-Z-89
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the application by First Realty Manage-
ment Group, Inc., to permit a limited waiver for 30
additional parking spaces for Swanson West Plaza, Petition
#5-Z-89, is HEREBY APPROVED, and such limited waiver would
not be detrimental to the public safety, health and welfare
of the citizens of the City.
SECTION 2: Additional conditions established in order to
grant a limited waiver of parking are set forth as follows:
1. This waiver is made a part of the approved site
plan and, as such, affects the land and will remain
in effect regardless of the passage of ownership of
the parcel from one owner to another, unless and
until the Synagogue use vacates the premises.
2. Any occupational licenses issued for this Swanson
Center will be bound by the parking requirements of
the Tamarac Code. The occupational license for the
Synagogue (even though no fee will be paid by the
Synagogue) will not be issued until the contract
with Broward Community College for the High Holy
day services is provided to the City.

3. The City of Tamarac must receive a letter from the
Temple stating that it will not apply for the use
of any additional space in the Swanson West
Building because there is inadequate parking. The
City may entertain such a request in the future if
the owners of Swanson West can demonstrate that
sufficient square footage and parking spaces have
been vacated by other tenants to accommodate
increased Temple use in accordance with all
applicable provisions of the Tamarac Code.
SECTION 3: This Resolution shall become effective upon
adoption.
