R-89-// A RESOLUTION AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE AN INTER -LOCAL ASSISTANCE AGREEMENT AND ADDENDUM THERETO WITH THE CITY OF LAUDERHILL CONCERNING CERTAIN MEDIAN LANDSCAPING ON COMMERCIAL BOULEVARD BETWEEN NORTHWEST 64 AVENUE AND UNIVERSITY DRIVE; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the appropriate City officials are hereby authorized to execute an Inter -Local Assistance Agreement and Addendum thereto with the City of Lauderhill concerning certain median landscaping on Commercial Boulevard between Northwest 64 Avenue and University Drive, a copy of said agreement being attached hereto as "Exhibit 1". SECTION 2: That the City Clerk is hereby authorized and directed to record said agreement in the public records of Broward County, Florida, SECTION 3: This Resolution shall become effective upon adoption. W I T W E S S E T H WHEREAS, Tamarac and Lauderhill have determined, upon investigation and inquiry, that it is in their best interest to complete certain median landscaping ("Median") on Commercial Boulevard between Northwest 64th Avenue and University Drive; WHEREAS, Tamarac and Lauderhill have been awarded and have accepted a Beautification Grant in the amount of 12CL,116]a-52 from the Florida Department of Transportation and must match said Grant with an equal amount of cash or, in -Kind contribution; S WHEREAS, Tamarac and Lauderhill have determined that it is also in their best interest to provide for the design and installation of an irrigation system and the sharing of the costs thereof ; NOW THEREFORE, in consideration of the mutual covenants herein contained, the legal sufficiency of which is hereby acknowledged, the parties agree as follows: SECIIEN Li* CEEIN111ONS- Scope of Work: Provide labor- and materials necessary to or incidental to the implementation of the Beautification Grant Project i.e., grant administration, irrigation and landscaping design and installation, preparation of bid documents. Maintenance: Shall mean the proper watering and fertilization of all plants and keeping them as free as practical from disease and harmful insects; to properly mulch the the plant beds; to keep the premises free of weeds; to mow and/or cut the grass to a proper height; to prune properly all plants, which includes (a) removing dead or diseased parts of plants, (b) removing such plants which interfere with adequate sight distance. In -Kind contributions: Those casts provided through existing city staff or resources or through the efforts of volunteers for labor, materials and supplies. In -kind contributions will be calculated as. the actual costs for, quantities or the hourly rate of an employee times the number of hours. worked. All costs must be documented and submitted in an acceptable format to be approved by the Grant Administrator. Tamarac shall be responsible for those tasks identified in Exhibit A and made a part of this agreement thereof. The administrator is responsible for maintaining adequate documentation for in -Kind contributions and shall determine allowable and acceptable in -Kind contributions. WITNESSETH WHEREAS, Commercial Boulevard acts as the municipal border between Tamarac and Lauderhill and as a result the median for Commercial Boulevard is owned by both TAMARAC and LAUDERHILL; and WHEREAS, TAMARAC and LAUDERHILL have jointly applied for and received a matching beautification grant in the amount of $30,060.57 from the Florida Department of Transportation for the beautification of the Commercial Boulevard median from University Drive to Northwest 64th Avenue; said property being more particularly described in Exhibit "A" attached hereto; and C� R-8? iio C; 89- ifo WHEREAS, TAMARAC and LAUDERHILL wish to enter into an Agreement outlining the respective responsibilities for each City in landscaping and maintaining the grant area. i NOW, THEREFORE, in consideration of the mutual promises, terms and convenants hereinafter set forth, TAMARAC and LAUDERHILL agree as follows: 1. The above recitals are true and correct and incorp- orated herein. 2. TAMARAC agrees to install the necessary irrigation system for the Commercial Boulevard median from University Drive to Northwest 64th Avenue. 3. LAUDERHILL agrees to install and maintain the necessary Xeriscape landscaping materials in accordance with the approved landscaping plan. 4. LAUDERHILL and TAMARAC hereby, indemnify and hold each other harmless for any loss, claim, cause of action or demand of any kind resulting from any act of their respective employees, agents, subcontrac- tors, successors, or assigns, arising out of the installation and maintenance of the median of Commercial Boulevard between University Drive and Northwest 64th Avenue. 5. This Agreement shall be recorded in the public • records of Broward County. 6. LAUDERHILL and TAMARAC agree that the original Interlocal Assistance Agreement and this Addendum may be terminated by either party upon thirty (30) days written notice to the other. 7. All other terms of the original Interlocal Assist- ance Agreement between Lauderhill and Tamarac shall remain in full force and effect.
