CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-89-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA, EXPRESSING OPPOSITION TO
PROPOSED ALTERATIONS TO HJR 139; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, local governments are often required to
shoulder the economic burdens of statutory mandates; and
WHEREAS, certain legislation titled HJR 139, as
originally proposed, would require a 3/4 vote of the
legislature to pass an unfunded mandate; and
WHEREAS, the Intergovernmental Relations Subcommittee of
the House Community Affairs Committee has proposed
substantial alterations to HJR 139 to require only a 3/5,
rather than a 3/4, vote of the legislature to pass an
unfunded mandate; and
WHEREAS, the City Council believes that legislation
which puts substantial economic burdens on the local
governments, without commensurate funding from the state,
should receive special scrutiny.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: Expression of Opposition. The City Council
hereby expresses its opposition to proposed alterations to
HJR 139, which alterations would have the effect of reducing
the level of legislative scrutiny over legislation which
would result in 'putting an economic burden on local
governments, and the City Council believes that any unfunded
legislative mandate should, at a minimum, receive a minimum
vote of 3/4 of the legislature for passage.

SECTION 2: The City Clerk shall deliver copies of this
Resolution to the Honorable Governor, Bob Martinez, to the
President of the Senate, John Vogt, to the Honorable Speaker
of the House of Representatives, Tom Gustafson, to
Representatives C. Fred Jones, Harry C. Good, Jr., James
Burke, Carl Carpenter, Jr., Corrine Brown, Jim Davis, Lincoln
Diaz-Balart, Elaine Gordon, Robert Harden, Harry Jennings,
Ray Liberti, Charles L. Nergard, Jefferson Reaves, Sr., Debby
P. Sanderson, Ronald A. Silver, Jack Tobin, Joseph Arnall,
Jeffrey C. Huenick, Nilo Juri and Buzz Ritchi, to the Florida
League of Cities, to the Broward and Dade County League of
Cities, and to all municipalities of the State of Florida.
SECTION 3: This Resolution shall become effective
immediately upon adoption.
