CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-89-
A RESOLUTION AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO EXECUTE AN AGREEMENT WITH MARSH-
MCBIRNEY, INCORPORATED FOR THE PURCHASE OF THREE
(3) PORTABLE RECORDING OPEN -CHANNEL FLOW METERS,
AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That the appropriate City officials are
hereby authorized to execute an Agreement with Marsh--
McBi.rney, Incorporated for the purchase of three (3) portable
recording open -channel flow meters at a total cost of
$15,376.00 as a sole source purchase, a copy of said
agreement being attached hereto as "Exhibit 1".
SECTION 2: This Resolution shall become effective upon
adoption. 01-1

AGREEMENT BETWEEN
THE
CITY OF TAMARAC
f
AND
MARSH-MCBIRNEY, INCORPORATED
RELATING TO THE PURCHASE
PORTABLE RECORDING OPEN -CHANNEL FLOWMETERS
This is an Agreement between the City of Tamarac, a
Florida municipal corporation ("City"), and Marsh -
McBirney, Incorporated, a Maryland Corporation, its
successors and assigns ("Marsh-McBirney, Incorporated").
WITNESSETH:
WHEREAS, the City of Tamarac has determined that it must
add to the existing inflow -infiltration detection equipment
at Tamarac Utilities, West by purchasing three (3)
Portable Recording Open -channel Flowmeters (Mod. 260-32); and
WHEREAS, the required Flowmeters must be compatible with
• the existing system used by the Utility, and therefore, the
purchase of these devices is a sole source purchase; and
WHEREAS, Section 9-39 of the City of Tamarac Code of
Ordinances requires that sole source purchases in an amount
over two thousand ($2,000.00) dollars be the subject of a
formal written contract approved by the City council.
NOW, THEREFORE, IN CONSIDERATION of the mutual terms and
conditions promises, covenants and payment hereinafter set
forth City and Marsh-McBirney, Incorporated agree as follows:

1. The above recitals are incorporated herein and are
made a part of this agreement.
2. Marsh-McBirney, Incorporated agrees to provide three
(3) Portable Recording Open --channel Flowmeters (Mod 260-32).
41 The price for each Flowmeter (Mod. 260-32) is five thousand
one hundred twenty-five ($5,125.00) dollars.
3. The City and Marsh-McBirney, Incorporated agreed that
the above quoted price shall include delivery of the three
(3) flowmeters.
IN WITNESS whereof the parties hereto have made and
executed this Agreement on the respective dates under each
signature. The City of Tamarac signing by and through its
Mayor, authorized to execute same by city Council action on

Marsh-McBirney, Incorporated, signing by and through its
President duly authorized to execute same.
